Items Relating to the Jewett Annexation and Zoning.
RECOMMENDATION:
Staff recommends approval of the annexation and zoning request. The
Planning and Zoning Board voted 7-0 to recommend approval of the annexation
and requested zoning.
EXECUTIVE SUMMARY:
A. Hearing and First Reading of Ordinance No. 137, 1987, Annexing
Approximately 37.58 Acres, Known as the Jewett Annexation.
B. Hearing and First Reading of Ordinance No. 138, 1987, Zoning
Approximately 37.58 Acres, Known as the Jewett Annexation, into the
R-L-P, Low Density Planned Residential, Zoning District.
This is a request to annex and zone approximately 37.58 acres, located
south of Douglas Road, north of Richards Lake Road and west of County Road
11, which is presently an enclave of county area completely surrounded by
incorporated area of the City of Fort Collins. The requested zoning is the
R-L-P, Low Density Planned Residential, Zoning District.

BACKGROUND:
The area is a county enclave. The following annexations to the City of
Fort Collins created the enclave:
N: Country Club North 2nd Annexation, January 1984
E: Country Club North 2nd Annexation, January 1984
S: Country Club North 2nd Annexation, January 1984
W: Country Club North 2nd Annexation, January 1984
The area has thus been eligible for involuntary annexation into the city
since January 1987. On June 30, 1987, staff sent a letter to the property
owner informing him of the pending annexation, potential zoning district
designation, and meeting date of review by the Planning and Zoning Board.
Staff received no contact from the property owner until the evening of the

Planning and Zoning Board meeting on July 27, when Mr. Jewett asked several
question about City police protection and security for farm animals he
keeps on the property.
Zoning
The requested zone for this annexation is the R--L-P, Low Density Planned
Residential, Zoning District. The R-L-P district designation is for areas
which are expected to develop predominantly with residential land uses.
Single-family residential subdivisions are "uses -by-right" in the R-L-P
zone. Any higher density residential uses and/or any non-residential land
uses can be proposed for development in the R-L-P zone as planned unit
developments and be evaluated according to the criteria of the LAND
DEVELOPMENT GUIDANCE SYSTEM. The surrounding property is also zoned R-L-P.
RECOMMENDATION:
Findings
1. The annexation of this area as a county enclave is consistent with the
policies and agreements between Larimer County and the City of Fort
Collins contained in the INTERGOVERNMENTAL AGREEMENT FOR THE FORT
COLLINS URBAN GROWTH AREA.
2. The area meets all criteria included in State law to qualify for a
county enclave eligible for involuntary annexation by the City of Fort
Collins.
3. The R-L-P zoning district is in conformance with the City's
Comprehensive Plan.
STAFF RECOMMENDATION
Staff recommends approval of the annexation and requested zoning.
PLANNING AND ZONING BOARD RECOMMENDATION
The Planning and Zoning Board, at their regular monthly meeting of July 27,
1987, voted to recommend approval of the annexation and requested zoning.
At the Board's meeting, the property owner, Mr. Norman Jewett, raised
several questions about the extension of City police protection to the
property after annexation and security for farm animals (sheep) which he
keeps on the property. A copy of the Board's minutes is attached.
. RESOLUTION 87-140
OF THE COUNCIL OF THE CITY OF FORT COLLINS
SETTING FORTH FINDINGS OF FACT AND DETERMINATIONS
REGARDING THE JEWETT ANNEXATION
WHEREAS, annexation proceedings were heretofore initiated for property
to be known as the Jewett Annexation; and
WHEREAS, following Notice given as required by law, the City Council
has held a hearing on said Annexation.
NOW, THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE CITY OF FORT
COLLINS:
Section 1. That the City Council hereby finds that the area proposed
to be annexed has been entirely contained within the boundaries of the City
of Fort Collins for a period of not less than three (3) years prior to this
date.
Section 2. That the City Council hereby finds that the requirements
of the applicable parts of Sections 31-12-104 and 105, C.R.S. have been
met.
Section 3. That the City Council further finds and determines that an
election pursuant to Section 31-12-107(2) or 31-12-112(1), C.R.S., is not
• required.
Section 4. That no additional terms and conditions are to be imposed
upon the area proposed to be annexed.
Section 5. That the City Council further finds that notice was given
and hearing was held regarding the annexation in accordance with Sections
31-12-108 and 109, C.R.S., as applicable.
Section 6. That the City Council concludes that the area proposed to
be annexed in the Jewett Annexation is eligible for annexation to the City
of Fort Collins and should be so annexed.
Passed and adopted at a regular meeting of the Council of the City of
Fort Collins held this 6th day of October, A.D. 1987.

ORDINANCE NO. 137, 1987
OF THE COUNCIL OF THE CITY OF FORT COLLINS
ANNEXING PROPERTY KNOWN AS THE
JEWETT ANNEXATION
TO THE CITY OF FORT COLLINS, COLORADO
WHEREAS, the property hereinafter described below has been entirely
contained within the boundaries of the City of Fort Collins for more than
three (3) years prior to this date; and
WHEREAS, the Council of the City of Fort Collins has determined that
it is in the best interests of the citizens of the City of Fort Collins to
annex said area to the City, as required by the terms of the
Intergovernmental Agreement between the City and Larimer County, Colorado,
dated August 3, 1983; and
WHEREAS, Resolution 87-104 setting forth the intent of the City
Council to annex said area has heretofore been adopted; and
WHEREAS, notice of this annexation has been given pursuant to the
annexation laws of the State of Colorado.
NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF FORT
COLLINS:
Section 1. That the following described property: •
A tract of land situated in the Northwest 1/4 of Section 30,
Township 8 North, Range 68 West, of the 6th P.M., County of
Larimer, State of Colorado, being more particularly described as
follows:
Considering the East line of the Northwest 1/4 of said Section 30
as bearing N 00'01'00" E and with all bearings contained herein
relative thereto:
Commencing at the Southeast corner of the Northwest 1/4 of said
Section 30; thence N 90°00'00" W 290.00 feet along the South line
of the Northwest 1/4 of said Section 30 to the true point of
beginning; thence N 90°00'00" W 1130.00 feet; thence
N 37°48'00" W 1140.00 feet; thence N 27°55'00" E 530.00 feet;
thence S 76°44'00" E 810.00 feet; thence S 58°59'00" E 570.00
feet; thence S 18°27'00" E 500.00 feet; thence S 40°49'00" E
300.00 feet; thence S 15°03'45" W 194.86 feet to the true point

BEING AN ORDINANCE
AMENDING CHAPTER 118 OF THE CODE OF THE
CITY OF FORT COLLINS, COMMONLY KNOWN AS THE
ZONING ORDINANCE, AND CLASSIFYING FOR ZONING PURPOSES
THE PROPERTY INCLUDED IN THE JEWETT ANNEXATION
TO THE CITY OF FORT COLLINS, COLORADO
BE IT ORDAINED BY THE COUNCIL OF THE CITY OF FORT COLLINS:
Section 1. That the Zoning District Map adopted by Chapter 118 of the
Code of the City of Fort Collins be, and the same hereby is, changed and
amended by including the property known as the Jewett Annexation to the
City of Fort Collins, Colorado, in the "R-L-P," Low Density Planned
Residential Zoning District:
A tract of land situated in the Northwest 1/4 of Section 30,
Township 8 North, Range 68 West, of the 6th P.M., County of
Larimer, State of Colorado, being more particularly described as
