PROTECT DESCRIPTION: This is a request to allow a used car sales lot with
automotive repair at 1420 North College Avenue. The lot contains 17,850
square feet (.40 acre) and is located on the east side of North College
Avenue, south of Bristlecone Drive. The parcel is zoned H-B, Highway Busi-
ness.
RECOMMENDATION: Approval
EXECUTIVE SUMMARY: The applicant is the owner and operator of Expert Auto
Sales which is presently a zoning violation in the H-B Zone. Under the
terms and conditions of the Zoning Administrator, the applicant is seeking
final PUD approval or risk cease and desist orders.
The Planning and Zoning Board approved a variance in the minimum rewired
score of 50% on the Auto -Related and Roadside Commercial Point Chart. The
Preliminary PUD approval also included two conditions relating to side lot
landscaping and the barriers along the future access drive. Both of these
conditions have been satisfied, and the final PTTD is found to be in sub-
stantial conformance with the preliminary PUD.

granted based on unusual circumstances such as the inability to assemble a
minimum two acre parcel, and the historic access onto College Avenue. Also,
the Planning and Zoning Board felt the improvement proposed by this PUD
request would benefit the general area and, perhaps, act as a catalyst in
the upgrading of neighboring properties.
3. Conditions of Approval:
The preliminary approval was granted with two conditions:
1. It was conditioned that the landscaping on the north and south
property lines should be intensified and upgraded to include trees.
Response: The final landscape plan shows the addition of two trees
on the south property line and three trees on the north property
line. In addition to the five new trees, the final landscape plan
shows an increase of 18 shrubs designated to be placed in mulched
planting beds.
2. It was conditioned that the future access drive should be shown to
have no permanent barrier to the north and south that would hinder
potential use as an accessway.

Response: The final site plan shows railroad ties as the proposed
barrier at the north and south ends of the future access drive. The
purpose of this non -permanent barrier is to promote internal access
between the adjacent parcels should the area to the north redeve-
lop.
RECOMMENDATION
Staff finds that the final PUD for North College Properties is in substan-
tial conformance with the preliminary plan. The two conditions of prelimi-
nary approval relating to side lot landscaping and the future access drive
have been met. Staff, therefore, recommends approval of the final PUD for
North College Properties.

Dear Mr. Klingensmith:
This letter is to serve as a summary of our meeting of December 7, 1g87
attended by yourself; Dick Rutherford, Stewart's and Associates; and Anne
Fernan and Ted Shepard of the City of Fort Collins. The following repre-
sents a time line of events and the obligations to satisfy the zoning viola-
tion on the property:
1. December 14, 1987: Anticipated final approval of the P.U.D.
2. December 28, 1987: Expiration of the appeal period for the P&Z action.
3. January 1, 1988: The Zoning Administrator will issue a temporary certi-
ficate of occupancy to allow the used car sales in the H-B zone.
4. February 1, 1988: The temporary certificate of occupancy will expire.
In its place, the improvements called for on the P.U.D. document must
either be in place and ready to be inspected or these improvements must
be covered by a letter of credit, performance bond, or escrow account.
It is important that the letter of credit, or other form of surety, be
accompanied by the landscape bid. The amount must be for 125% of the value
of the bid. The expiration should be July 31, 1988 which will allow one
full planting season for the improvements to be installed.
Any changes to the approved landscape plan must be reviewed by the Planning
Department.
5. As owner of the business, you may apply for the sign permit. This is a
separate procedure. The leading edge of the sign must be setback two
feet from the property line. There must be at least six feet of clearance
between the sign and the ground. You may apply for the permit any
time after December 14, 1988.

6. Please contact Anne Fernan of the Zoning Department when you are ready
for a site inspection. This should occur at least one month before the
expiration date on the letter of credit of July 31, 1988 so any corrections
can be made. Don't forget to include the handicap parking space, the raised
handicap parking sign, and the bicycle parking.
It is our hope that we can assist you in getting final approval for your
business at this location. Please contact either Ann Fernan or myself if
there are any questions about the procedures or requirements.
