C. Hearing and First Reading of Ordinance No. 104, 1997, Amending the Zoning District Map
of the Code of the City of Fort Collins and Classifying for Zoning Purposes the Property
Included in the Link-N-Greens Annexation to the City of Fort Collins, Colorado.
This is an annexation and zoning of an enclave of approximately 2 acres of the Cache La Poudre
River and adjacent bike trail, located between Riverside and Lemay Avenue. The recommended
zoning is GC-R, Community Commercial - Poudre River District.

BACKGROUND:
The Link-N-Greens 4th property is approximately 2 acres of the Cache La Poudre River and
adjacent bike trail, between Riverside and Lemay Avenue. It is located within the Fort Collins Urban
Growth Area (LTGA). According to policies and agreements between the City of Fort Collins and
Larimer County, contained in the INTERGOVERNMENTAL AGREEMENT FOR THE FORT

COLLINS URBAN GROWTH AREA, the City will agree to consider for annexation property in
the UGA when the property is eligible for annexation according to State law.
The surrounding zoning and land uses are as follows:
N: C-C-R; Link-N-Greens Golf Course
E: C-C-R and R-C; Link-N-Greens Golf Course, sewage treatment plant
S: R-C and R-D-R; sewage treatment plant, pickle factory
W: P-O-L; vacant
Enclave azeas become eligible for annexation when they have been completely surrounded, for at
least three yeazs, by properties that aze within the City limits. The area to be annexed has been an
enclave for at least three years and is therefore, eligible for annexation. The azea became completely
surrounded through the following annexations: .
N: Link-N-Greens A.nnexation - October 30, 1987
S: East Lincoln Avenue 2nd Annexation - July 26, 1991
E: Lincoln-N-Greens 2nd Annexation - April 15, 1988
W: East Lincoln Avenue 2nd Annexation - July 26, 1991
This area became eligible for involuntary annexation into the City on July 26, 1994. It was left out
of the previous Link-N-Greens annexations. This two-acre area is a stretch of the Cache La Poudre
River, south of the Link-N-Greens Golf Course. Annexation of this enclave is for housekeeping
purposes - when surrounding azea were annexed, the plat boundaries did not match resulting in this
enclave.
The proposed zoning for this annexation is the C-C-R, Community Commercial - Poudre River
District. The C-C-R District is for downtown fringe areas in the Cache La Poudre River corridor.
A copy of the C-C-R zoning district is attached. The surrounding area is zoned C-C-R, R-C and P-
O-L. The proposed zoning is consistent with the City Structure Plan and is compatible with the
surrounding zoning.
FINDINGS OF FACT:
1. The annexation of this azea is consistent with the policies and agreements between Larimer
County and the City of Fort Collins, as contained in the INTERGOVERNMENTAL
AGREEMENT FOR THE FORT COLLINS URBAN GROWTH AREA.
2. The area meets all criteria included in State law to qualify for annexation by the City of Fort
Collins.
3. The recommended C-C-R, Community Commercial - Poudre River District is in
conformance with the City Structure Plan.

STAFF RECOMMENDATION:
Staff recommends approval of the Link-N-Greens 4th Annesation and C-C-R, Community
Commercial - Poudre River District zoning.
PLANNING AND ZONING BOARD RECOMMENDATION:
At its regularly scheduled meeting on May 20, 1997, the Planning and Zoning Board voted 4-0 on
the consent agenda to recommend approval of the proposed annexation and zoning.

� RESOLUTION 97-93
OF THE COUNCIL OF THE CITY OF FORT COLLINS
SETTING FORTH FINDINGS OF FACT AND DETERMINATIONS
REGARDING THE LINK-N-GREENS 4TH ANNEXATION

VJHEREAS, annexation proceedings were heretofore initiated by the Council of the City of
Fort Collins for property to be known as the Link-N-Greens 4th Annexation; and
WHEREAS, following Notice given as required by law, the Council has held a hearing on
said Annexation.
NOW, THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE CITY OF FORT
COLLINS:
Section 1. That the Council of the City of Fort Collins hereby finds that the area
proposed to be annexed has been entirely contained within the boundaries of the City for a period
of not less than three (3) years prior to this date.
Section 2. That the Council hereby finds that the requirements of the applicable parts of
Sections 31-12-104 and 31-12-10�, C.R.S., have been met.
Section 3. That the Council further finds and determines that an election pursuant to Sections
31-12-107(2) or 31-12-112(1), C.R.S., is not required.
Section 4. That no additional terms and conditions are to be imposed upon the area
proposed to be annexed.
Section 5. That the Council further finds that notice was given regarding the annexation
in accordance with Section 31-12-108(2), C.R.S., as applicable.
Section 6. That the Council concludes that the area proposed to be annexed in the West
Drake Road 2nd Annexation is eligible for annexation to the City and should be so annexed.
Passed and adopted at a regular meeting of the Council of the City of Fort Collins held this

Section 2. That, in annexing said property to the City, the City does not assume any �
obligation respecting the construction of water mains, sewer lines, gas mains, electric service lines,
streets or any other services or utilities in connection with the property hereby annexed except as
may be provided by the ordinances of the City.
Section 3. That the City hereby consents, pursuant to Section 37-45-136(3.6), C.R.S.,
to the inclusion of said property into the Municipal Subdistrict, Northern Colorado Water
Conservancy District ("the Subdistrict"). Upon inclusion into the Subdistrict, said property shall be
subject to the same mill levies and special assessments as aze levied or will be levied on other
similarly situated property in the Subdistrict.

BE IT ORDAINED BY THE COUNCIL OF THE CITY OF FORT COLLINS as follows:
Section 1. That the Zoning District Map adopted pursuant to Division 1.3 of the Land
Use Code of the City of Fort Collins be, and the same hereby is, changed and amended by including
the property known as the Link-N-Greens 4th Annexation to the City of Fort Collins, Colorado, in
the C-C-R, Community Commercial - Poudre River District.
Section 2. That the Sign District Map adopted pursuant to Section 3.8.7(E) of the Land
Use Code of the City of Fort Collins be, and the same hereby is, changed and amended by showing
that the above-described property is not included in the Residential Neighborhood Sign District.
Section 3. That the Director of Community Planning and Environmental Services is
hereby authorized and directed to amend said Zoning District Map in accordance with this
Ordinance.

(A) Purpose. The Community Commercial - Poudre R.iver District (C-C-R) is
for downtown frin�e areas in the Cache La Poudre River carridor with both
public street frontage and River frontage. This District provides locations for
redevelopment or development of moderate intensity uses that are supportive
of downtown, subject to floodplain restrictions. Such redevelopment or
development shall be compatible with the scenic, cultural, natural, and
historical context of the River and downtown.
A main purpose of the District is to foster a healthy and compatible
relationship between the River, the downtown and surrounding urban uses.
Any significant redevelopment shall be desi�ed as part of a�master plan for
the applicable �roup of conti�uous properties.
(B) Permitted Uses.
� (1) The following uses are permitted in the C-C-R District, subject to
buildin� permit review, provided that such uses are located on lots
that are part of an approved site-specific development plan:
(a) Accessory/Miscellaneous Uses:
1. Accessory buildings.
2 Accessory uses.
(b) Any use authorized pursuant to a site specific development
plan that was processed and approved in compliance with the
Zoning Code in effect on March 27, 1997 (the date
immediately preceding the effective date of this Land Use
Code), provided that such use shall be subject to all of the use

development plan.

(c) Any use which was permitted for a specific parcel of property

(a) To the extent reasonably feasible, the layout of new streets
and walkways on-site shall emphasize the characteristics and
views of the River landscape utilizing special street design

Massing and placement.
1. HeightlMass. The maximum building height shall be
three (3) stories. If multi-story buildings are included
in a development; such buildings shall be designed to
step down to one (1) story directly adj acent to the
natural area protection buffer.
2. Parkin� lots. Buildin�s shall be sited so that any new
parkin� lots and vehicle use areas are located in
either: 1) interior biock locations between buildings
that face the street and buildings that face the River,
or 2) side yards.
3. Frequent views/access. No building wall shall exceed
one hundred twenty-five (125) feet on the axis along
the River.
Character and image.
1. Outdoor spaces. Buildings and extensions of
buildings shall be designed to form outdoor spaces
such _ as balconies, arcades, terraces, decks, or
courtyards, and to integate development with the
landscape to the extent reasonably feasible.
2. Windows. Windows shall be individnally defined
with detail elements such as frames, sills and lintels,
and placed so as to visually establish and define the
building stories and establish human scale and
proportion. Glass curtain walls and spandrel-glass
strip windows shall not be used as the predominant
style of fenestration for buildings in this District.
This requirement shall not serve to restrict the use of
atrium, lobby or �eenhouse-type accent features used
as embellishments to the principal building. •

3. Rooflines. A minimum pitch of 8:12 shall be used for
gable and hip roofs to the ma�cimum extent feasible.
Where hipped roofs are used alone, the minimum
pitch shall be 6:12. Flat-roofed buildings shall feature
three dimensional cornice treatment on all walls
facing streets, the river, or connecting walkways,
unless they are stepped and terraced back to form a
usable roof terrace area(s). A single continuous
horizontal roofline shall not be used on one (1) story
buildings except as pait of a design style that
incorporates corbelled masonry and/or cornices.
Color/Materials.
1. Predominant buildin� colors shall be subdued or
neutral shades, within a medium or moderately dark
range of value, and not white or reflective.
2. Textured unit masonry such as brick, stone, and
tinted, variously textured concrete masonry units, as
well as treated wood sidin�, shall be used in repeating
pattem as integral parts of the building fabric to the
maximum extent feasible. Any other exterior
materials, if used, shall be used as inte�al parts of the
overall building fabric, in repeatin� modules,
proportioned both horizontally and vertically to relate
to human scale, and with enoujh depth at joints
between architectural elements to cast shadows.
Site Design.
(a) Landscaping/Vegetation Protection. The natural qualities of
the River landscape shall be maintained and enhanced using
plants and landscape materials native to the River comdor in
the design of site and landscape improvements.
