RECOMMENDATION: Staff recommends adoption of the Resolution. EXECUTIVE SUMMARY: /' �yzrz �� � S ��ZG��1 % p�� /� �-� , L� The properiy being considered for annexation has, for a period of not less than three (3) years, been completely surrounded by property contained within the boundaries of the City of Fort Collins. The property being considered for annexation is approximately two acres in size and is actually a portion of the Cache La Poudre River between Riverside and Lemay Avenue. The proposed zoning for this annexation is CCR - Community Commercial - Poudre River District. The proposed Resolution states that it is the City's intent to anneY this enclave property and directs that the published notice required by State law be given of the Council meeting to consider the needed annexation ordinance. The time of First Reading of the annexation and zoning ordinances is scheduled for July 1, 1997. Not less than thirty days prior published notice is required by State law. BACKGROUND: The property is located within the Fort Collins Urban Growth Area (UGA). According to policies and agreements between the City of Fort Collins and Larimer County contained in the Intergovernmental Agreement for the Fort Collins Urban Growth Area, the City will agree to consider annexation of property in the UGA when the property is eligible for annexation according to state law. The property became completely surrounded by the City of Fort Collins through the following annexations: N: Link `n Greens Annexation - October 30, 1987 E: East Lincoln Avenue 2nd Aruiexation - July 26, 1991 S: Link `n Greens 2nd Annexation - April 15, 1988 W: East Lincoln Avenue 2nd Annexation - July 26, 1991 The property became eligible for annexation as an enclave on July 26, 1994. 2 The annexation is made up of one parcel. The owner of record is: Dorothy A. Whisler c/o Link `n Greens Corp. 777 E. Lincoln Avenue Fort Collins, CO 80524 Planning and Zoning Board Recommendation The Planning and Zoning Board conducted a public hearing on the annexation and zoning request at its regular monthly meeting on March 24, 1997. The Board recommended that the Council approve this anne:cation by a vote of 5-0. � L_J • RESOLUTION 97-71 OF THE COUNCIL OF THE CITY OF FORT COLLINS STATING THE INTENT OF THE CITY OF FORT COLLINS TO ANNEX CERTAIN PROPERTY AND INITIATING ANNEXATION PROCEEDiNGS FOR SUCH PROPERTY TO BE KI�10W1�1 AS THE L1NK `N GREENS 4TH ANNEXATION WHEREAS, the property hereinafter described has, for a period of not less than three (3) years prior to this date, been completely contained within the boundaries of the City of Fort Collins; and WHEREAS, the Council desires to initiate annexation proceedings in accordance with State law. NOW, THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE CITY OF FORT COLLINS as follows: Section 1. Containing 4.211 Acres. � . • Section 2. That the Council hereby initiates annexation proceedings for the above- described property. Section 3. That the Notice attached hereto be adopted as a part of this Resolution. Said Notice establishes the date, time and place when the Council will consider the passage of an annexation ordinance pertaining to the above described property. The City Clerk is directed to publish a copy of this Resolution and said Notice as provided in C.R.S. Section 31-12-108(2). Passed and adopted at a regular meeting of the Council of the City of Fort Collins held this 20th day of May, A.D. 1997.
