RECOMMENDATION: Staff recommends adoption of the Resolution and adoption on First Reading of the annexation and zoning Ordinances. The Planning and Zoning Board voted 6-0 on its January 25 Consent Calendar to recommend approval of the annexation and zoning request to the City Council. EXECUTIVE SUMMARY: A. Resolution 88- 26 Finding Substantial Compliance and Initiatinc� Annexation Proceedings for Link-N-Greens Second Annexation. Q. First Reading of Ordinance No. �� , 1988, Annexing Approximately 16.84 Acres Known as Link-N-Greens Second Annexation. C. First Reading of Ordinance No. 21 , 1988, Zoning Approximately 16.84 Acres Known as Link-N-Greens Second Annexation, into the RC, River Corridor, Zoning District. This is a request to annex and zone approximately 16.84 acres located south of Lincoln Avenue, west of Lemay Avenue and north of the Poudre River. The requested zoning is the RC, River Corridor, Zoning District. The property is presently developed as part of the Link-N-Greens golf course. BACKGROUND: The applicants and owners, James P. and Ruth Alice Hoffman, have submitted a written petition requesting annexation of approximately 16.84 acres located south of Lincoln Avenue, west of Lemay Avenue and north of the Poudre River. The requested zoning is the RC, River Corridor, Zoning District. The property is presently developed as a part of the Link-N-Greens Golf Course. The property owners have requested annexation in fulfillment of a previous out-of-city utility agreement for sewer service to the Link-N-Greens Golf Course, which required annexation of the property once it became eligible for annexation according to state law. This is a voluntary annexation. The property is located within the Fort Collins Urban Growth Area. According to policies and agreements between the City of Fort Collins and Larimer County contained in the INTERGOVERNMENTAL AGREEMENT FOR THE FORT COLLINS URBAN GROWTH AREA, the City will annex property in the UGA when the � DATE: February 16, 19f3£i I -2- I ITEM NUMBER: � a-� property is eligible for annexation according to state law. The property gains the required 1/6 contiguity to existing city limits from a common boundary with the Link-N-Greens Annexation to the west, the Wastewater Treatment Plant #1 Annexation to the south, and the Northeast Consolidated Annexation to the north. The requested zoning for this annexation is the RC, River Corridor, Zoning District. The RC district designation is for implementation of the Poudre River Trust Policies Plan adopted by the City Council in 1986. The property is presently developed as a golf course. According to the Poudre River Trust Policies Plan, an open space type utilization of land such as a golf course is encouraged in this portion of the community. This site addresses the locational policies. FINDINGS: The annexation of this area is consistent with the policies and agreements between Larimer County and the City of Fort Collins contained in the INTERGOVERNMENTAL A6REEMENT FOR THE FORT COLLINS URBAN GROWTH AREA. 2. The area meets all criteria included in state law to qualify for voluntary annexation to the City of Fort Collins. 3. The attached Resolution accepts the annexation petition and determines that the petition is in compliance with state law. The Resolution initiates the annexation process for this property by establishing the date, time and place when a public hearing will be held regarding the Ordinances annexing and zoning the area. Public hearings and second readings of the Ordinances annexing and zoning the property will be considered by the City Council on April 5, 1988. 4. The requested RC, River Corridor, Zoning District is in conformance with the policies of the City's Comprehensive Plan. STAFF RECOMMENDATION Staff recommends approval of the annexation and requested zoning. PLANNING AND ZONING BOARD RECOMMENDATION: The Planning and Zoning Board heard the request for annexation and zoning at its regular monthly meeting on January 25, and voted 6-0 to recommend approval to the City Council.
