This letter is in res�onse to your letter of February 4, 1988 concerning
the Impact Report for the Link-N-Greens Second Annex:a.tion. Your letter
indicates that the xeport satisfies the requirements of CRS 31-12-1a8.5;
however, I would like to point out several discrepancies between your
report and the statutory requirements.
The State Statute clearly requires that impact reports snall be filed
witn the Board of County Corir:i:issioners at leas.t twenty (2�J) days be.fore
the date of the hearing established pursua.nt to Section 31=12-1�d8 of
said Statute. Your letter is dated February 4, 1988 and the report
indicates that the City Council will consider the annexation on February
16, 1988. Simple arithmetic should suffice to demonstra�e.that the
minimum time frame spelled out in the Statute has not been met.
The maps submitted with your report, while undoubtedly accurate, are of
such a scale as to be worthless for any attempt at determi.ning the
impact of a proposed annexation on County services and facilities. T,he
present and pr.oposed boundaries of the municipality are required by the
Statute. I would be very interested to see the actua_l.annexation. plat
to determine if 'tne area is indeed a perfect cixcle as depicted in your
impact report. Simply including a copy of the annexation plat or a copy
of the petition, with the legal description, in the impact report packet
would enable the County to conduet a meani:ngful review of the report.
While not directly related to tne im�act xeport requirements, the
Statute does also require that the County be notii:ied of proposed
annexations.,by...._registered mail. The mailing shall include a cogy of the
��publisned annexation not.ice_,_ t.ogether with a copy of tne resolution and
,petition as filed. This notice is to be sent to both the County
�Conm'rssioners and the County Attorney. To the best of my knowledge, we
have not reveived the required notice.

G.iven the i.ncomplete nature of the impact report and the limited time
given for review, which is not in compliance with the statutory
requirements, Lar.imer County respectfully requests €hat the City Council
consideration of Link-N- Greens Second Annexation be del.ayed until
oroper, legal notice is given to Larim.er Gounty according to the minimum
provisions of CRS 31-12-1�8.5 and 3i-12-108.
