Dear Ms. Whisler:
I am in receipt of a copy of a letter from. Kenneth G.
Waido to you with regard to the annexation of your property to
the City of Fort Collins. A copy of his letter is enclosed.
Mr. Waido has advised me that, to the present time, you have
not responded to his request to petition for annexation into
the City. As you know, the provision to you of out of City
sewer service by the City of Fort Collins was conditioned upon
your agreement that at such time as your property was eligible
for annexation, and upon request from tha City, you would join
in the petition for such annexation. Unless the City has
received such petition from you on or before the close of busi-
ness April 24, 1987, the City will be left with no alternatiVe
but to re-analyze whether- you should continue to benefit from
the provision of City sewer service to your property. The City
shall consider your failure to so petition for annexation on or
before said date as a breach of the Out of City Sewer Service
Agreement between you and the City. Accordingly, if it is your
intention to refuse to volunteer for annexation of your prop-
erty into the City, you should begin immediately to arrange for
the provision of alternative sewer service to the property.

On Oecember 3, 1986, you entered into an Out of City Sewer Service Aqree-
ment with the City of Fort Collins for a piece of property located south of
Lincoln Street and north of the Poudre River. Part of that agreement
states:
That at such time as the property i s el i gi bl e under the l aws of the
State of Colorado and the ordinances of the City of Fort Collins, Colo-
rado then in effect for annexation to the City and upon appropriate
request of the Gity through its duly authorized agents, they will join
in a petition requesting annexation to the City and will do a�l other
things necessary, requisite and proper in order to annex said property
to the Gity..
The purpose of this letter is to make such a formal request on behalf of
the City of Fort Collins, Col`orado,.for annexation of the property. I have
review the legal description of the property and it is now eligible for
annexation. I have enclosed an annexation petition which. requires your
signature, an attorney's certification of ownership, and the signature of a
Notary Public. "
