The Applicant has submitted a PDP application for a 4,013 square foot, one-story bank
located at the southwest corner of East Harmony Road and Boardwalk Drive. The bank
includes four drive-through lanes and is located on a site 1.8 acres in size. The parcel is
bounded by Harmony Road on the north, Boardwalk Drive on the east, Miramont Office
Park on the south and the Front Range Baptist Church on the west.

NOTICE OF PUBLIC HEARING: Evidence presented to the Hearing Officer established
no controversy or facts to refute that the hearing was
properly posted, legal notices mailed and notice
published.
PUBLIC HEARING
The Hearing Officer, presiding pursuant to the Fort Collins Land Use Code, opened the
hearing at approximately 4:00 p.m. on July 17, 2002 in Conference Rooms C&D at 281
North College Avenue, Fort Collins, Colorado.
HEARING TESTIMONY, WRITTEN COMMENTS AND OTHER EVIDENCE:
The Hearing Officer accepted during the hearing the following evidence: (1) Current
Planning Department Staff Report; and (2) application, plans, maps and other
supporting documents submitted by the applicant and the applicant's representatives to
the City of Fort Collins. The LUC, the City's Comprehensive Plan (City Plan), and the
formally promulgated policies of the City are all considered part of the evidence
considered by the Hearing Officer.

FACTS AND FINDINGS
1. Site Context and Background
The surrounding zoning and land uses are as follows:
N: MMN; Existing Convenience Store and Apartments (7-Eleven and The Pier)
S: HC; Existing Offices (Miramont Office Park)
E: HC; Existing Regional Shopping Center (Harmony Market-Red Robin
Restaurant)
W: HC; Existing Church (Front Range Baptist Church)
The parcel is a portion of a larger annexation approved in 1980. In 1987, the
parcel was included in the original Oak-Cottonwood Farm Overall Development
Plan. In 1994, the original Bank One at Harmony Market P.U.D. was approved.
This project consisted of a 3,600 square foot bank and an 11,000 square foot,
two-story retail/office building. This project subsequently expired.
2. Compliance with the Oak-Cottonwood Farm O.D.P.:
The proposed bank use is consistent with the "office/retail" use designated on the
approved Oak-Cottonwood Farm O.D.P. and all subsequent amendments.
3. Compliance with Article 4 and the HC Zoning District Standards:
The Project Development Plan complies with all applicable requirements of
Article 4 and the HC Zone District. In terms of land use, offices are a permitted
use in the Harmony Corridor zone district subject to a Type I(Administrative
Review). The PDP complies with all applicable design standards of the Harmony
Corridor.
4. Compliance with Article 3 of the Land Use Code — General Development
Standards
There was no evidence provided at the hearing to contradict the Staff Report;
therefore, the Hearing Officer finds that the Project is in conformance with Article
3.

SUMMARY OF CONCLUSIONS
�
A. The Bank One Fort Collins at Miramont Park PDP is subject to administrative
review and the requirements of the Land Use Code (LUC).
B. The Bank One Fort Collins at Miramont Park PDP is consistent with the approved
Oak-Cottonwood Farm ODP and all subsequent amendments.
C. The Bank One Fort Collins at Miramont Park PDP satisfies the development
standards of the HC zoning district.
D. The Bank One Fort Collins at Miramont Park PDP complies with all applicable
General Development Standards contained in Article 3 of the Land Use Code.
DECISION
The Bank One Fort Collins at Miramont Park PDP, #54-87AR, is hereby approved by
the Hearing Officer without condition.
