EXECUTIVE SUMMARY
A.G. Wassenaar, Inc. (AGW) has performed a Phase I Environmental Site Assessment in general
conformance with the scope of work and limitations of the ASTM International Standard Practice
Designation E1527-13 for the subject property, identified as the Triangle Road Development in
Fort Collins, Colorado. Any exceptions or deletions from this practice are described in Section 11.0
of this report.
The subject property is an irregular shaped parcel approximately 35 acres in size. The site has a
slight topographic trend to the east and consists of grasses and weeds. An unnamed creek
meanders in and out of the subject property and a meter station, associated with a nearby
pipeline, is located south of the site. None of the visible features were determined to be RECs in
relation to the subject property.
The subject property is located in a rural developing residential area. Large lot single family homes
predominantly surround the subject property to the east and residential neighborhoods are
located to the north and west. None of the surrounding properties are identified as RECs in
relation to the subject property.
Based on AGW’s historical review, the property was predominantly vacant land used for
agricultural purposes as early as 1906. A farmstead was located adjacent to the north, that
included several structures in the vicinity of the subject property boundary. These structures were
no longer in place by the 1990s. None of the past uses are determined to be RECs in relation to
the subject property.
The area surrounding the subject property has been used mostly for agricultural purposes since
at least 1906. Several farms were located in the area to the east and north. Residential
development began in the late 1960s with the construction of large lot single family homes to the
east, across Highway 285, and smaller lot residential neighborhoods being constructed to the
north and west in the late 1990s. None of the past uses of the surrounding properties are
identified as RECs in relation to the subject property.
Publicly available records revealed several potential offsite sources of contamination within a one-
mile radius of the subject property. AGW reviewed publicly available information and none of the
offsite listings were determined to be RECs in relation to the subject property.
This assessment has revealed NO evidence of recognized environmental conditions
(RECs) in connection with the subject property.

1.0 INTRODUCTION AND SCOPE OF WORK
On behalf of Goodwin Knight, A.G. Wassenaar, Inc. (AGW) has completed a Phase I
Environmental Site Assessment (ESA) for the subject property identified as the Triangle Road
Development in Fort Collins, Colorado.
The goal of this Phase I ESA is to identify recognized environmental conditions (RECs), defined
as the presence or likely presence of any hazardous substances or petroleum products in, on, or
at a property: (1) due to any release to the environment; (2) under conditions indicative of a
release to the environment; or (3) under conditions that pose a material threat of a future release
to the environment. Solid, liquid, and vapor phase contaminants are included when considering
potential releases. The term REC is not intended to include de minimis conditions that generally
do not present a material risk of harm to public health or the environment and that generally
would not be the subject of enforcement action if brought to the attention of appropriate
government agencies.
AGW’s assessment is designed to be in general accordance with the practice of performing Phase
I ESAs as established by the ASTM International Standard Practice Designation E1527-13. This
Practice is intended to permit a user to satisfy one of the requirements to qualify for the
“landowner liability protections” or “LLPs” under the Comprehensive Environmental Response,
Compensation, and Liability Act (CERCLA) (42 U.S.C. §9601), that is, the practice that constitutes
“all appropriate inquiries” into the previous ownership and uses of the property consistent with
good commercial and customary practice as defined by CERCLA.
The client named on this report and any lending institutions the client is working with specific to
this property may rely on the report for 180 days provided they accept the scope of the original
proposal and report as prepared for the client. Reliance or any use of this report by any other
group is prohibited and therefore will be at their own risk. No warranties are made to any such
party.
This report was written to summarize AGW’s findings during a Phase I ESA of the subject property.
The subject property was evaluated for potentially significant onsite environmental contamination
through a property inspection, a review of historical property uses, interviews with individuals
associated with the property, and a review of environmental records available from government
agencies. This report identifies RECs (if any) which have been identified in relation to the subject
property.
Environmental issues (among others) not included in the scope of work for a Phase I ESA include
radon, lead-based paint, asbestos identification, and wetlands and endangered species
evaluations. The collection and specific laboratory analyses of environmental samples were not

part of the scope of this Phase I ESA; therefore, no specific quantitative environmental data was
generated.
2.0 SITE DESCRIPTION
The subject property can generally be described as a portion of the southeast ¼ of Section 14;
Township 6 North; Range 69 West of the Sixth Principal Meridian. Physical setting information for
the site is described in Table 1, below, and Figure 1 of this report depicts the general location of
the subject property.

3.0 SITE HISTORY
The historic land uses of the subject property and the surrounding areas were examined with the
purpose of interpreting, where possible, the past activities that have or may have negatively
impacted the natural resources of the site. Copies of the topographic maps and aerial photographs
used for reference are included in Attachment A of this report.

4.0 SITE RECONNAISSANCE
The property was inspected during a site visit on September 3, 2019. The inspection included a
thorough visual survey of the subject property (including a physical inspection of the property
grounds for visible signs of contamination or contamination sources), as well as a drive-by survey
of the nearby area. Photographs taken during the site visit are included in Attachment B. Visible
characteristics of the subject property are described in Table 4, below, and depicted in Figure 2.

A review of public records was completed by GeoSearch. This record search was defined to meet
or exceed the ASTM guidelines for a Phase I ESA records search. The search area defined by
ASTM varies from the subject property to a maximum radius of one mile.

Resource Conservation & Recovery Act (RCRA) facilities lists; Federal, State, and tribal-equivalent
institutional control/engineering control registries; Federal Emergency Response Notification
System (ERNS) list; State and tribal landfill and/or solid waste disposal site lists; State and tribal
lists of hazardous waste sites identified for investigation or remediation; State and tribal registered

The accuracy and completeness of record information varies among information sources,
including government sources. Neither the user of this report, nor AGW, is obligated to identify
mistakes or insufficiencies in the information provided, however, AGW has made a reasonable
effort to compensate for mistakes or insufficiencies that are obvious in light of other information
of which AGW has actual knowledge.

5.1 Underground Storage Tank Facilities (UST)
The Colorado Department of Labor and Employment, Division of Oil and Public Safety (OPS)
maintains this list of UST facilities. The GeoSearch database report lists two registered USTs within
¼ mile of the subject property. AGW has reviewed the location and status of these tanks. Any
releases from these tanks are addressed in Section 5.3, Leaking Storage Tank Facilities (LST),
above. Otherwise, the UST is not identified as RECs in relation to the subject property, based on
hydrologic position and/or the lack of reported leaks.

5.2 Emergency Response Notification System (ERNSCO)
This National Response Center database contains data on reported releases of oil, chemical,
radiological, biological, and/or etiological discharges into the environment anywhere in the United
States and its territories. The data comes from spill reports made to the United States
Environmental Protection Agency (EPA), United States Coast Guard, the National Response Center
(NRC) and/or the United States Department of Transportation (USDOT).

5.3 Resource Conservation & Recovery Act - Generator Facilities (RCRAGR08)

in the RCRAInfo system. The United States Environmental Protection Agency (EPA) defines
RCRAInfo as the comprehensive information system which provides access to data supporting
the Resource Conservation and Recovery Act (RCRA) of 1976 and the Hazardous and Solid Waste
Amendments (HSWA) of 1984. RCRAInfo replaces the data recording and reporting abilities of
the Resource Conservation and Recovery Information System (RCRIS) and the Biennial Reporting

5.3 Leaking Storage Tank Facilities (LST)
The Colorado Department of Labor and Employment, Division of Oil and Public Safety (OPS)
maintains this listing of leaking aboveground and underground storage tank facilities. The
GeoSearch database report lists five LSTs within ½ mile of the subject property. AGW has
reviewed the location and status of these tanks and has included in the table below all LST sites
within ¼ mile and all sites that have not been granted closure status by the OPS. The remaining

Mr. Mark Johnson, of Goodwin Knight, completed the “User Questionnaire for Landowner Liability
Protections” in accordance with the ASTM International Standard Practice Designation E1527-13,
on September 4, 2019. A copy of the completed questionnaire is included as Attachment D.

have been filed or recorded against the subject property.

The user does not have any specialized knowledge of the subject property and is unaware of any

7.0 INTERVIEWS
7.1 Current Owner
Travis Ackerman, Cushman Wakefield
AGW corresponded with Mr. Travis Ackerman on October 28, 2019. Mr. Ackerman stated he is
not aware of any historical environmental concerns associated with the site. In addition, he is not
aware of any structures previously existing on the property.

7.2 Local Government Official
Poudre Fire Authority
AGW corresponded with the Poudre Fire Authority on September 9, 2019, in regard to a request
to search available records to determine if any hazardous material spills or other incidents of
environmental concern have been reported for the subject property. They indicated no records
for the property were found.
8.0 FINDINGS AND OPINION
• The subject property is an irregular shaped parcel approximately 35 acres in size. The site
has a slight topographic trend to the east and consists of grasses and weeds. An unnamed
creek meanders in and out of the subject property and a meter station, associated with a
nearby pipeline, is located south of the site. None of the visible features were determined
to be RECs in relation to the subject property.
• The subject property is located in a rural developing residential area. Large lot single
family homes predominantly surround the subject property to the east and residential
neighborhoods are located to the north and west. None of the surrounding properties are
identified as RECs in relation to the subject property.
• Based on AGW’s historical review, the property was predominantly vacant land used for
agricultural purposes as early as 1906. A farmstead was located adjacent to the north,
that included several structures in the vicinity of the subject property boundary. These
structures were no longer in place by the 1990s. None of the past uses are determined to
be RECs in relation to the subject property.
• The area surrounding the subject property has been used mostly for agricultural purposes
since at least 1906. Several farms were located in the area to the east and north.
Residential development began in the late 1960s with the construction of large lot single
family homes to the east, across Highway 285, and smaller lot residential neighborhoods
being constructed to the north and west in the late 1990s. None of the past uses of the
surrounding properties are identified as RECs in relation to the subject property.
• Publicly available records revealed several potential offsite sources of contamination within
a one-mile radius of the subject property. AGW reviewed publicly available information
and none of the offsite listings were determined to be RECs in relation to the subject
property.

9.0 CONCLUSION
We have performed a Phase I ESA in general conformance with the scope of work and limitations
of the ASTM International Standard Practice Designation E1527-13 for the property, identified as
the Triangle Road Development in Fort Collins, Colorado. Any exceptions to, or deletions from,
this practice are described in Section 11.0 of this report.
This assessment has revealed NO evidence of recognized environmental conditions
(RECs) in connection with the property.
10.0 LIMITATIONS
The professional judgments expressed in this report meet the standard of care for our profession.
AGW has completed the services in a manner consistent with the level of care and skill ordinarily
exercised by other consultants practicing in the same locality and under similar circumstances
and time. The opinions derived within this report are time dependent and conditions can and will
change.
AGW’s assessment is limited to identifying potential environmental liabilities associated with the
property of concern. Not identifying hazardous substances or petroleum products on the property
should not be interpreted as a guarantee that the materials do not exist. It is merely a statement
indicating that the probability of contamination on the subject property should be minimal based
on site characteristics, and the historical and current uses of the site and surrounding areas. This
opinion is rendered based upon property inspection, client-provided information, information from
interviews with knowledgeable persons regarding property history, and information provided by
governmental and regulatory agencies. Information is obtained on a reasonably ascertainable
basis as it pertains to costs, timeliness, and availability, and is believed to be from reliable sources;
however, no responsibility is assumed for its accuracy since AGW was not retained to verify
publicly available information.
No environmental site assessment can wholly eliminate uncertainty regarding the potential for
RECs in connection with the property. Performance of this practice is intended to reduce, but not
eliminate, uncertainty regarding the potential for RECs in connection with a property, and
recognizes reasonable limits of time and cost. All appropriate inquiry does not mean an exhaustive
assessment of a property.
11.0 DATA GAPS
This Phase I ESA has been completed in general accordance with ASTM International Standard
Practice E1527-13. The inability to obtain specific information required by this Standard despite

good efforts by the environmental professional is considered a data gap. This may occur when a
review of standard historical sources fails to achieve the historical research objectives (data
failure), interviews are not available, or a site visit is not able to be conducted. The environmental
professional has the discretion to determine if, in their opinion, a significant data gap has
occurred, impacting the ability of the environmental professional to identify RECs.

promulgation of implementing regulations in 1980. In 1984, the State was authorized by EPA to implement the
RCRA program in Colorado on their behalf. This facility listing includes RCRA sites listed as generators of
hazardous waste (Small Quantity Generators and Large Quantity Generators) and was provided by the Colorado
Department of Public Health and Environment.
Small Quantity Generators (SQG) generate, in any calendar month, more than 100 kg (220 lbs.) but less than

time, no more than 1 kg (2.2 lbs.) of acute hazardous waste and no more than 100 kg (220 lbs.) of material from

Conditionally Exempt Small Quantity Generator, but accumulated, at any time, more than 1,000 kg (2,200 lbs.) of
RCRA hazardous waste.
Large Quantity Generators (LQG) generate, in any calendar month, 1,000 kg (2,200 lbs.) or more of RCRA

active, not active, open, and closed sites are included in this data. The next set of data is obtained from the
Active and Closed OPS Petroleum Release Events in Colorado database. This data includes the OPS Open
Event locations, but also shows locations of closed events (releases that have been issued a No Further Action
determination). The Events data utilized in this database includes the following status types: Brownfield,
Closed, Enforcement, LUST Trust, Open and State Lead.
LUSTTRUST Leaking Underground Storage Tanks Trust Fund Sites

Suspected tank leaks have been discovered at the sites are included in this database, but the facility responsible
for the leak has not been identified. The state's investigation and search for responsible parties is paid for out of
the state's Leaking Underground Storage Tank (LUST) Trust Fund. This data was originally collected in 2002
from the Colorado Department of Labor & Employment, Division of Oil & Public Safety, State Fund Section by a
former environmental database company known as Satisfi. Please refer to State LST database as source of
current LUST Trust sites.
METHANESITES Methane Gas Study Sites

This Investigation of Methane Gas Hazards report was prepared by the Denver Office of Emergency
Preparedness in 1981. The purpose of this study was to assess the actual and potential generation, migration,
explosive and related problems associated with specified landfills, and to identify existing and potential problems,
suggested strategies to prevent, abate, and control such problems and recommend investigative and monitoring
functions as may be deemed necessary. The Colorado Department of Health selected eight landfills as priorities
due to population density and potential hazards to population and property.

UMTS Uranium Mill Tailings Sites

There were nine uranium mill tailings sites in Colorado designated for cleanup under the federal Uranium Mill
Tailings Radiation Control Act (UMTRA). These nine sites, know commonly as UMTRA sites, were remediated
jointly by the State of Colorado and the U.S. Department of Energy during the late 1980's and early 1990's. Mill
tailings were removed from 8 of the mill sites and relocated in engineered disposal cells. A disposal cell is
designed to encapsulate the material, reduce radon emanation, and prevent the movement of water through the
material. At one site, Maybell, CO, the tailings were stabilized in-place at the mill site. After remediation of the
tailings was completed, the State and DOE began to investigate the residual impacts to groundwater at the mill
sites. The groundwater phase of the UMTRA program is on-going. This database was provided by the Colorado
Department of Public Health and Environment.
VCRA Voluntary Cleanup and Redevelopment Program Sites

This list of Voluntary Cleanup and Redevelopment Program Sites is maintained by the Colorado Department of
Public Health and Environment (CDPHE) and includes both voluntary cleanup and brownfield properties. The
Voluntary Cleanup and Redevelopment program was created in 1994. The objective of the program is to
facilitate the redevelopment and transfer of contaminated properties. Properties that sit untouched because of
their real or perceived contamination can be rehabilitated using the CDPHE's Brownfields Program in
conjunction with the Voluntary Cleanup Program. Cleanup decisions are based on existing standards and the
proposed use of the property. The actual cleanup and verification is the owner's responsibility.
HWSCA Hazardous Waste Sites- Corrective Action

The Resource Conservation and Recovery Act (RCRA) was enacted by congress in 1976, followed by the
promulgation of implementing regulations in 1980. In 1984, the Hazardous and Solid Waste Amendments
(HSWA) were added to RCRA providing for corrective action at facilities subject to RCRA. That same year, the
State was authorized by EPA to implement the RCRA program in Colorado on their behalf. Corrective action
may be implemented as part of a RCRA Hazardous Waste Permit, an Order, or a Corrective Action Plan
pursuant to the Colorado Hazardous Waste Regulations. Corrective action is the process by which regulated
facilities investigate and remediate, as necessary, all contamination (soil, ground water, surface water, air)
associated with their releases into the environment. Historic Corrective Action Sites are facilities that have
completed the RCRA Subtitle C corrective Action process. This database was provided by the Colorado

EXPERIENCE
Mr. Scott began working with A.G. Wassenaar, Inc. in November 2018. He was hired as a staff
environmental scientist for the Environmental Department. He has experience in the environmental
consulting industry, performing and managing diverse soil, groundwater, and vapor investigation and
remediation projects.
Mr. Scott’s field experience includes conducting drilling, sampling, and testing programs to identify
soil and ground water contamination; and implementing bioremediation and chemical treatment
technologies. He has designed, installed, and maintained groundwater and soil treatment systems,
chemical injection systems, and soil vapor extraction systems. In addition, Mr. Scott has experience
in the preparation of technical reports for hydrologic and subsurface investigations. He also has
experience with baseline water well testing in accordance with Colorado Oil and Gas Conservation
Commission (COGCC) Rule 318A, as well as, experience in conducting site investigations and
documentation preparation for the EPA’s Spill Prevention, Control, and Countermeasure (SPCC)
program.
Mr. Scott also conducts, prepares, and reviews Phase I Environmental Site Assessments for both
buyers and sellers of commercial, residential, and industrial real estate.
