Box 580 Fort Collins, CO 80522-0580 970.221.6750 970.224.6134 - fax fcgov.com/Currentp/anning Thru: Tom Leeson, Community Development and Neighborhood Services Director, City of Fort Collins From: Stephanie Blochowiak, Environmental Planner, City of Fort Collins Jason Holland, City Planner, City of Fort Collins RE: Additional Environmental Information Request for Potential Willow and Pine Multifamily Project Development Plan (PDP) Submittal Mr. Sadowy and Ms. Candau, This additional environmental information request serves as a follow-up to the environmental coordination meeting held on March 8, 2018, for the potential Willow and Pine Multifamily development project at the southwest corner of Pine and Willow Streets in Fort Collins, CO. The potential development project includes Schrader Oil parcels 9712210010, 9712207025 and 9712207018. As discussed at the coordination meeting, the Schrader Oil site has known subsurface contamination. In September 2002, an oily sheen was observed and reported near the south bank of the Cache La Poudre River in Fort Collins. Investigation revealed a non -aqueous phase liquid (NAPE) "plume" and associated concentrations of organic compounds that exceeded soil and groundwater quality criteria and other ecological screening values. It was determined the plume originated on the former gas plant property, located on what is now the Schrader property, and extended under Willow Street to the Cache La Poudre River. In November 2004, a Removal Action under the Federal Comprehensive Environmental Response, Compensation, and Liability Act (CERCLA) was initiated by the United States Environmental Protection Agency (EPA). The City of Fort Collins, Public Service Company of Colorado (PSCo), EPA, and Schrader Oil were identified as stakeholders: PSCo and Schrader Oil were identified as responsible parties, liable for cleanup of the site. In 2004 the City, Schrader Oil Company, PSCo and the EPA entered into an Administrative Order on Consent (the "AOC"), which allocated responsibility for cleanup costs and set forth legal responsibilities and commitments of the parties. In order to maintain the integrity of the AOC required remediation and to protect human health and the environment, the Schrader Oil Willow and Pine Multifamily Development Submittal Requirements for City of Fort Collins Environmental Compliance Review Unless specifically stated otherwise, all items listed are to be submitted at first round PDP. 1. Copy of notification letter sent to all beneficiaries of the Covenant to Restrict Use of Property, Larimer County Clerk and Recorder Reception #2004-0118593, regarding potential development. (Electronic copy received by City on March 21, 2018). 2. Documentation confirming beneficiaries have no objections to the proposal and provided prior to scheduling a project Hearing with the City Planning and Zoning Board. 3. Phase I Environmental Site Assessment (ESA) and Limited Subsurface Assessment, Schrader Shop, 223 Willow Street, dated November 14, 2016 using ASTM Practice E 1527-13 and AAI in 40 CFR 312. (Electronic copy received by City on March 14, 2018). 4. Maps of Geographic Extent of Subsurface Contamination: a. At first round PDP, if not before, submit professionally mapped diagrams of the soil and groundwater contamination investigated during the Limited Subsurface Assessment that demonstrate the geographic extent of subsurface contamination exceeding applicable land use screening levels. These maps (e.g., benzene and naphthalene groundwater plumes) were not included in the original ESA November 2016 report, but will be needed to ensure the safety of construction and utility workers and for planning purposes (e.g., designing stormwater infrastructure). 5. Soil Characterization and Management Plan that is specific to this site and potential development and per all applicable requirements. 6. Environmental Compliance Action Plan: a. Narrative statement of opinion, prepared by a qualified environmental professional, addressing how the project complies with each City Action, restrictions and requirements in the AOC. b. Statement regarding subsurface mapping and exploration. i. With the initial development application, provide an executive summary document and supporting narrative that provides an overview addressing all Environmental Site Assessments (Phase I and II) and subsurface exploration reports provided with the development application, with a statement of opinion, prepared by a qualified professional, that the scope of the exploration provided is sufficient for the proposed development project to meet LUC 3.4.2 and 3.4.9. This summary document should include a map depicting current site characterization information regarding subsurface soil and groundwater contamination. ii. The executive summary should also address: 1) whether additional subsurface exploration is recommended, and 2) any potential gaps in knowledge of the extent and volume of subsurface contamination at this potential development site. 8. Signed Developer Statement Indicating Understanding: a. That if the City of Fort Collins will need its own and independent professionally qualified environmental consultant to assist in the technical review and evaluation of the potential Willow and Pine Multifamily development project environmental studies, sampling results, technical information and site and building design protection proposals, that this is a cost the developer shall bear. b. That should extra time for development review cycles be necessary in order to include time necessary to consult the City's outside experts, this will impact timing and steps going forward in the entitlement process. * Per LUC 2.2.3(C)(1), additional information may be requested during the development review process as needed in order to provide a recommendation to the decision maker (City Planning and Zoning Board) or to comply with other relevant public agency requirements. Additional City review time may be required at submittals in order to process and thoroughly review the proposed development application for any project proposed at this site.
