Many of the sections were updated in 2016 and I know that others have had trouble finding the updated copies on the Larimer County site, so just to make sure that you have the latest language I've attached them. In addition to the easements being shown on the street cross sections (which I didn't attach, but can send you) this section does identify the easements that are to be provided. In regards to your question as to why a Professional Engineer needs to prepare the variance request - that is what the criteria requires and in part because of the desire and need for the Engineer to state that why in their professional opinion that the request is the appropriate solution and that it will not be detrimental. It gets back to the requirements and ethics involved in being a licensed Engineering and that if they propose something that is unsafe or unethical it could impact their license. I don't know why Stuart & Associates will not prepare the request for you. These request have been prepared and submitted many other engineering firms. I would hate to see you need to hire another engineer, but this requirement has not been something that I can waive. May be you can try them again or they would be willing to work with you on a letter that they would be willing to sign and stamp. The code section to which you refer (1.9.2.B.2) states On -Site criteria & says nothing as to what easements are required. I assumed you would be sending me copies of those requirements. Could you also enlighten me as to why a Professional Engineer needs to prepare the Variance request. The engineers who prepared the subdivision plat, Stewart & Associates, state emphatically that they do not need to prepare the request but that the property owner should. I feel that I'm caught in Catch 22 here. You said that there was no charge for the variance but if I have to secure a different engineer my expenses will be substantial. Here is the section of the Larimer County Urban Area Street Standards that identifies the easement requirement. It is: Section 1.9.2.B.2. and then the easements are also shown on each standard street cross section. If your engineer has any questions about this please have them call me.
