LUC 2.211 Lapse, Rounds of Review: Applicants, within one hundred eighty
(180) days of receipt of written comments and notice to respond from the City
on any submittal (or subsequent revision to a submittal) of an application for
approval of a development plan, shall file such additional or revised submittal
documents as are necessary to address such comments from the City. If the
additional submittal information or revised submittal is not filed within said
period of time, the development application shall automatically lapse and
become null and void.

LUC 2.211 Lapse, Term of Vested Right: Within a maximum of three (3) years
following the approval of a final plan or other site specific development plan, the
applicant must undertake, install and complete all engineering improvements
(water, sewer, streets, curb, gutter, street lights, fire hydrants and storm

drainage) in accordance with city codes, rules and regulations. The period of
time shall constitute the "term of the vested property right." Failure to undertake
and complete such engineering improvements within the term of the vested
property right shall cause a forfeiture of the vested property right and shall
require resubmission of all materials and reapproval of the same to be
processed as required by this Code. All dedications as contained on the final
plat shall remain valid unless vacated in accordance with law.

A meeting has been scheduled for April 14 to discuss amendments to the South
College Storage Development Agreement (DA). The DA for Mars Landing will
be impacted by the outcome of this meeting, so the DA cannot be finalized until
after that meeting.

The draft of the Development Agreement (DA) cannot be completed until all
materials requested by Environmental Planning have been submitted. Please
submit these materials as soon as possible. The project cannot be approved
until the DA has been finalized and signed.

Thank you for adding a note to the landscape plan regarding College Ave
improvements. I will need to check this again on the full landscape and utility
plans prior to recording. Once the payment-in-lieu amount has been
determined, you will need to submit the payment prior to approval.

If the South College Storage DA is amended, Mars Landing will provide a
payment-in-lieu for College Ave frontage improvements. In this case, a note will
need to be added to the plans to indicate that any College Ave improvements

depicted on the plans are conceptual and not for construction.

Stormwater is requiring dedication of drainage easements. Since the property
is not being replatted with this project, the dedications will be done by separate
document. Please use the General Deed template available at
https://www.fcgov.com/engineering/devrev.php. For each easement, you will
need to submit the $725 dedication fee, the completed deed, the legal
description and exhibit, and closure reports. We will review the deed, legal
description, and exhibit. When we have determined that the information is
correct, you and your attorney will sign the deed.

3/25/2022 REMINDER: FOR DCP ISSUANCE
Prior to issuance of the Development Construction Permit (DCP), and prior to
prairie dog removal, please submit the results of a burrowing owl survey
completed by a professional, qualified wildlife biologist, and in accordance with
the Division of Parks and Wildlife standards if removal is between March 15
and October 31. Note the timing requirements of these surveys are between
March 15 and October 31, as no burrowing owls are expected to be present
between November 1 and March 14. This issue is required due to the presence
of prairie dogs on the site.

Raptor Center standards.

Staff has provided the Raptor Program's prairie dog removal and donation
requirements. Please share this with the licensed professional removing the
prairie dogs for guidance. It is City staff's expectation that the prairie dogs will
be donated to the Raptor Program. Staff requires a letter from the raptor
program indicating compliance with this mitigation requirement. If prairie dogs
are not donate, the developer will be responsible for paying a payment in lieu for
mitigation. Mitigation costs shall be $6,000 in addition to the cost of euthanizing
the prairie dogs.
