RE: The Hamlet at Miramont, Final P.U.D., #54-87AF
Dear Mr. Shepard:
Thank you for the information shared with Mr. Dave Brown in your telephone conversation on January 17,
relative to your December 4, 1995 letter to Mr. Mick Aller of Aller-Lingle Architects P.C.
I i-mderstand that the City of Fort Collins Planning and Zoning Board approved The Hamlet at M;r rnont, Final
P.U.D., #54-87AF, on November 20, 1995, conditional to completion and City staff approval of:
1. Development agreement
2. Final utility plans
3. Final P.U.D. plans
As Mr. Brown indicated, KEM Homes, Inc. is in the process of coordinating several project elements with legal
counsel, lenders, engineers, and architects, particularly as the project is impacted under the requirements of
the Colorado Common Interest Ownership Act (CCIOA) (38-33.3). 1 feel that all parties will be best served if
certain considerations, particularly as related to construction phasing, are clarified prior to submission/approval
of (final) development agreements and plans. While I do not anticipate any major alterations or delays, I do
wish to proceed with diligence in light of CCIOA requirements.
I understand that the City process allows an automatic extension of thirty days, for up to six consecutive months,
if the (final) development agreements and plans have not been completed and approved by City staff. Thus,
the project is notjeopardized because these conditions may not have been met prior to the January 22, 1996,
Planning and Zoning Board meeting.
Please contact me should any of the above understanding be incorrect. Thank you for forwarding a copy of
the City planning process flow chart. I will keep you updated as to the status of these issues.
