O . BOX 5 (T8 100 Fort Coll* CO 80522 Please find enclosed a copy of the preliminary site plan for Pad 5, Harmony Market. I previously have discussed with the both of you, the fact that Mr. Solsky and Mr. Morgan intend to build an approximate 14,000 square foot building on this site of which the westerly 4,000 square feet of the building will be owned by Mr. Morgan and the easterly 10,000 square feet of the building will be owned by Mr. Solsky. I have outlined in red the dividing line between the Solsky and Morgan "parcels" of the building. The lot is currently being purchased with a metes and bounds description but is proposed to be processed as a one lot subdivision. They are intending to request a building permit for the one building on the one lot, but after completion of the building, to divide the building into the Morgan parcel and the Solsky parcel by a separate description such as, "the westerly feet of Lot 5 for Morgan and the easterly feet of lot 5 for Solsky". The parties would also have_a_par_ty wall agreement and each side of the building will have' separate utility services.+)METERS• fVt) PENFTKnl)°rJs of: r'jFT'l WALL %ort Paul Eckman has indicated that such a separation of rrov+oRYea parcels will not be a prohibited "subdivision of land" within the meaning of the City Code and that it will be legally R,ap. acceptable to the City, subject to compliance with the nE_r7 applicable building code and zoning requirements. The vac non -building portion of the lots will be made subject to t O A reciprocal parking and use easement. 00051S. Because we are within one week of a submittal to the City staff, I thought it was important that you have a chance to see written outline of the proposed course of action with respect to this property as well as a visual presentation so if Page Two August 16, 1994 you have any questions or problems with our approach, you could let us know immediately.
