Nye Title Examiner Security Title Guaranty Co. 343 West Drake, Suite 200 Fort Collins, CO 80526 Dear Mr. Nye: This letter is in response to your request for status information on Red Robin at Harmony Market P.U.D. Specifically, you asked about the permitted land use and whether or not an appeal of the Planning and Zoning Board's decision had been filed. 1. Status: Red Robin at Harmony Market, Sixth Filing, was granted final P.U.D. (Planned Unit Development) approval on June 6, 1994. This approval grants a vested right for three years under Colorado law for an 8,500 square foot standard restaurant located on approximately 1.52 acres at the southeast corner of Harmony Road and Boardwalk. The P.U.D. documents (Site Plan, Landscape Plan, Architectural Plans) are the binding documents which determine the extent of the improvements allowed to be constructed on the subject property. 2. Appeal: The time period for any party -in -interest to appeal the Planning and Zoning Board's decision on Red Robin Final P.U.D. was on Monday, June 20, 1994, at 5:00 p.m. This time period has expired and no appeal has been received by the City Clerk's Office.
