To: City of Fort Collins Planning & Development Services, and Poudre Fire Authority
Project: 209 Cherry St Mixed Use
Subject: Proposed Alternative Provisions in Lieu of Aerial Apparatus Access
This letter is being provided to describe the proposed Alternative Method of Compliance as follows:
A full Aerial Apparatus Access provision will not be feasible for this site since the available run on the
west side alley is limited to 150-foot from Cherry St for a one-way access, and the building’s west façade
continues beyond that distance. Cherry St is too far away from building to comply with the 15-to-30 foot
offset requirement, and Mason St is a non-eligible Arterial. We are proposing select high-rise provisions
in lieu of aerial access. The determination of these provisions is focused upon the protection and
fortification of the stair shafts and greater access to the roof during emergencies, to both aid the
operations of the Fire Department and provide the building’s occupants with safer conduits for egress.
Here is a summary of the proposed "High-Rise" features to be provided in lieu of Aerial Apparatus
Access addressed in this letter:
Item #1 : Increased fire ratings of the stair and elevator shafts from 2 hour to 3 hour.
Item #2 : Emergency lighting in stair shafts.
Item #3 : Increased width of the stairways for better fire personnel access, 4’-4” wide.
Item #4 : Both stair shafts provided access to the roof with a full personnel door/walk out access.
The design in March 8th PDP includes this.
Item #5 : Smokeproof stair enclosure with mechanically ventilated stairwells.
Thank you for taking the time to review our proposed High-Rise features to be provided in lieu of Aerial
Apparatus Access. We hope you will find our commentary useful in final determination of the items
addressed above.
For reference, the following pages are email correspondence to date regarding proposed High-Rise
features.
Sincerely,
Don Bernholtz, VFLA Architecture & Interiors

Hi Don and Marcys,
We do not intend to continue with access to the West. Only perimeter access from Cherry and the property from the
south (between the 2 Mason Flats bldgs). We have perimeter access well covered with these 2 locations. No other areas
for aerial -- just high rise provisions.
Thanks--

Thanks Marcus. For the West access question: we had assumed that because this was not going to satisfy the full side
of the building, then we would abandon that proposed aerial access, but if you wanted to re-evaluate that available
area as potentially suitable aerial access again, we’d be happy to continue that discussion.
For the stairwell emergency lighting option: would a battery-based system be sufficient for emergency power?

Hello Don,
I apologize about the delayed response on this. One thing I wanted clarification on was the access on the West. Is this
still proposed?

I spoke with the team and the high rise features you have proposed would probably work other than item 2. Reflective
tread nosing would need to be luminous. As an alternative to this, the Assistant Fire Marshal would approve full
stairwell lighting under emergency power.
To get these alternative methods approved, you will need to write a letter of request to the Fire Marshal for approval.
Thanks

Good morning, Marcus. We were curious if you had a chance to review the Exhibit we sent last Tuesday 1/31, and if
you either had any feedback to share or wanted to set up a meeting soon. Please let me know, as we have project team
meetings each Wednesday, and the Ownership has been looking to get resolve on this alternative high-rise features
proposal. Thanks

Marcus, please see attached Fire Access Exhibit. On this exhibit we are proposing 5 high-rise provisions we think are
effective alternative features to aerial access. Please review internally and let us know if PFA would agree with or
suggest other features that may be more beneficial in lieu of our proposed items. Thanks

Hello Don,
If aerial access is not an option for the site, then you would need to provide alternative methods of compliance (high-
rise provisions). Typically, the process would be writing a letter to the Fire Marshal requesting an alternative method
of compliance.
Thanks

Marcus, we wanted to check-in with you on the proposed site and building layout for 209 Cherry St. In our last
discussion, we had determined that the full aerial apparatus provision would not be feasible since the west side alley
was limited to a 150-foot from Cherry St for a one-way access. Cherry St is too far away form building, and Mason St is
deemed arterial. We were considering providing some high-rise provisions in-lieu of aerial access. Have you had any
internal discussion within PFA, or would you like to set up another meeting to discuss further?

Hi Marcus,
Thanks again for your time on Monday. After studying the options we discussed, a proposed fire lane in the enhanced
alley and on Mason makes the most sense. I have attached an exhibit for you to review and run by the fire marshal
before we start proceeding with design changes.
This approach is only feasible with acceptance from the Planning department on alternative compliance for the "Green
Edge" standards. We have reached out to discuss this with them. So, if this approach has to change in any way due to
those design constraints, we will let you know as soon as possible.
Thanks and have a great rest of your week.

Hi Marcus,
Do you have time next week to discuss the 209 Cherry St project? We went through PDR and received comments
from you and your team on 09/29/22. (Project #PDR220012).
In this meeting we would like to discuss your comments, as well as, some strategies for fire lanes and the 150'
perimeter requirements.
Tuesday and Wednesday next week are fairly open for Russell + Mills if there is a time that works for you those days.
This meeting would be through Zoom.

Thanks and we look forward to hearing from you.
