STAFF Ted Shepard City of Fort Collins PLANNING AND ZONING BOARD STAFF REPORT PROJECT: 1ST Bank at Harmony Market, Fourth Filing, Final P.U.D. , #54-87F APPLICANT: 1ST Bank c/o Cityscape Urban Design 3555 Stanford Road, Suite 105 Fort Collins, CO 80525 OWNER: Oak Farm, Inc. 3555 Stanford Road, Suite 100 Fort Collins, CO 80525 PROJECT DESCRIPTION: This is a request for Final P.U.D. approval for Phase Two of 1ST Bank at Harmony Market, Fourth Filing. Phase Two consists of a 7,700 square foot, permanent bank building with drive-thru service. The site is located on 2 .93 acres on Pad Six of the Harmony Market P.U.D. , located at the southwest corner of Harmony Road and Lemay Avenue. The parcel is zoned r-p, Planned Residential. RECOMMENDATION: Approval EXECUTIVE SUMMARY: 1ST Bank at Harmony Market, Fourth Filing, Phase Two Preliminary P.U.D. was approved by the Planning and Zoning Board on October 19, 1992 subject to the condition that the architectural elevations be modified to integrate the design elements established by the existing structures within Harmony Market P.U.D. The amended architectural elevations have been reviewed and found to satisfy the condition of approval by including the dominant architectural elements found in the center. The Final P.U.D. is in substantial conformance with the Preliminary. One condition of approval regarding the execution of the Development Agreement and Utility Plans has been attached to the recommendation of approval. Background: The surrounding zoning and land uses are as follows: N: R-L-P; Existing church and single family (Whalers Cove) S: r-p; Shopping center (Steele' s Market) E: b-p; Vacant (OakRidge Business Park) W: r-p; Vacant (future pad sites in Harmony Market P.U. D. ) Harmony Market P.U. D. (50 acres) was included as part of the Oak- Cottonwood Farm Overall Development Plan (271 acres) originally approved in 1987 . In April of 1989, Oak-Cottonwood Farm O.D.P. was amended to designate the Harmony Market as a Community/Regional Shopping Center. The following three filings have been approved within Harmony Market P.U. D. : Pace Warehouse at Harmony Market, Filing One - April, 1989 Builders Square at Harmony Market, Filing Two - July, 1990 Steele ' s Market at Harmony Market, Filing Three - Sept. , 1990 1ST Bank represents the first of six pad sites to develop along the Harmony Road frontage and is the Fourth Filing within the Harmony Market P.U. D. It is anticipated that there will be three pad sites on each side of the access drive that intersects with Harmony Road. On October 19, 1992 , the Planning and Zoning Board approved 1ST Bank at Harmony Market Phase One, Preliminary and Final P.U.D. (temporary structure) . At the same hearing, the Board approved 1ST Bank at Harmony Market Phase Two, Preliminary, subject to conditions, the primary condition relating to architectural compatibility. 2 . Condition of Preliminary Approval: At the October 19 , 1992 P & Z hearing, the Board attached the following condition to the Preliminary approval of 1ST Bank, Phase Two: "At the time of Final P.U.D. for the permanent building, that the architectural elevations for the permanent building be revised to integrate the elements established within Harmony Market P.U.D. Such elements are to be included as part of the architectural elevations which should be of sufficient detail to determine architectural character and submitted in a timely manner for review by the Planning and Zoning Board. " I 411 S 1ST Bank at Harmony Market P.U.D. , Final - #54-87F November 16, 1992 P & Z Meeting Page 3 In compliance with this condition, the applicant has submitted amended architectural elevations for evaluation and consideration by the Planning and Zoning Board. 3 . Architectural Design: The amended architectural design now includes a gabled roof feature that dramatizes the western elevation at the main entry. This feature is a translucent roof panel system that is compatible with the entries at Pace Warehouse, Builders Square, and Steele ' s Market. The building' s exterior will be a combination of beige synthetic stucco on the lower portions and brick on the upper portions. The brick banding will be a combination of tan and reddish-brown. Both the stucco and brick materials are reflective of the materials used on all three anchors within Harmony Market. Two horizontal rows of soldier course brick will tie into the horizontal banding on the three existing buildings. To the top of the gable roof feature, the height of the building is 25 feet. To the top of the brick parapet wall, the height of the building is 18 feet. The overall height will still allow the building to be located under the existing cottonwood trees with a degree of pruning. Together these architectural elements accomplish the task of integrating the bank building with the three existing anchor tenants. The use of similar entry and compatible materials promotes architectural unity within Harmony Market P.U.D. Because of the amended architectural character, Staff finds that the condition of approval has now been satisfied and that the permanent bank building complies with the expectation for compatible design within the Harmony Market P.U.D. RECOMMENDATION: Staff finds that the request for Final P.U. D. for 1ST Bank at Harmony Market, Phase Two satisfies the condition of approval as stated by the Planning and Zoning Board at the Preliminary P.U. D. Further, the Final P.U.D. is in substantial conformance with the Preliminary. Staff, therefore, recommends approval of 1ST Bank at Harmony Market, Fourth Filing, Phase Two, Final P.U. D. , 54-87F, subject to the following condition: 1. The Planning and Zoning Board approves this planned unit development final plan upon the condition that the development 411 • 1ST Bank at Harmony Market P.U.D. , Final - #54-87F November 16, 1992 P & Z Meeting Page 4 agreement, final utility plans, and final P.U.D. , plans for the planned unit development be negotiated between the developer and City staff and executed by the developer prior to the second monthly meeting (January 25, 1993) of the Planning and Zoning Board following the meeting at which this planned unit development final plan was conditionally approved; or, if not so executed, that the developer, at said subsequent monthly meeting, apply to the Board for an extension of time. The Board shall not grant any such extension of time unless it shall first find that there exists with respect to said planned unit development final plan certain specific unique and extraordinary circumstances which require the granting of the extension in order to prevent exceptional and unique hardship upon the owner or developer of such property and provided that such extension can be granted without substantial detriment to the public good. If the staff and the developer disagree over the provisions to be included in the development agreement, the developer may present such dispute to the Board for resolution if such presentation is made at the next succeeding or second succeeding monthly meeting of the Board. The Board may table any such decision, until both the staff and the developer have had reasonable time to present sufficient information to the Board to enable it to make its decision. (If the Board elects to table the decision, it shall also extend the term of this condition until the date such decision is made) . If this condition is not met within the time established herein (or as extended, as applicable) , then the final approval of this planned unit development shall become null and void and of no effect. The date of final approval for this planned unit development shall be deemed to be the date that the condition is met, for purposes of determining the vesting of rights.
