The following comments are offered: 1. It is anticipated that close coordination will be required among the applicant and the Chief Building Official and the Deputy City Attorney to draft an agreement regarding the City's ability to enforce the temporary nature of the modular structure. Staff remains comfortable with the three year approval, with extensions available to five years. The issue, however, is how to establish a binding procedure for removal after five years, if necessary, that is legally enforceable by the City. 2. Staff is concerned about placing the modular building so close to the berms that are within the 80 foot setback area along Harmony Road and the setback area along Lemay. Please provide cross-section view that illustrates this relationship and shows the grading between the modular and the berms. 3. The Utility Plans need to match the Site Plan by showing a sidewalk along Lemay and at the entry drive. In terms of sidewalks, please indicate what is existing and what is proposed. 4. Staff is concerned about protecting the trees during construction of both phases. Please add the following notation to both landscape plans: A. Existing trees to be saved should be marked with prominent identification where tree trunks are apt to be damaged. Trees should be protected with metal posts and snow fencing. B. Avoid cutting surface roots wherever possible. Sidewalks and paving levels should be contoured sufficiently to avoid such cutting. D. Root cuts from excavation should be done rapidly. Smooth flush cuts should be made. Back ill before the roots have a chance to dry out and water the tree immediately. 5. On the architectural sheet, please specify the color of the brick for the permanent building, and the dimension and wood type on the modular building. 6. Staff applauds the landscaping of the median at the entry drive off Lemay Avenue. We recognize that this is an "off-site improvement" and that this landscaped area was originally intended to be the responsibility of earlier development. Landscaping this median will help provide a finished look between Steele's and Pad Six. 7. Note number 6 should be revised to read as follows: "All signage on this.P.U.D. (for both the temporary and permanent building)is restricted to the number, type, location, and size as specifically noted on this P.U.D. Any changes or deviations shall be reviewed, in advance, by the City of Fort Collins by the administrative review procedure, including, at the Planning Director's discretion, referral to the Planning and Zoning Board. If any signs do not comply with the Sign Code, then specific variances will be requested." 8. Please indicate the dimensions of the free-standing sign on one of the available panels at the corner of Harmony and Lemay. According to the Zoning Administrator, the "Steele's" uses Harmony Road allowance and the other two panels will use Lemay Avenue allowance. The available Lemay Avenue allowance equals 120 square feet to be divided up in manner. Is it proposed that each of the two remaining panels will have 60 square foot of signage? Please specify. 9. The proposed I.D. sign on the southern internal access drive is not permitted according to the Sign Code. Properties may be granted signage based on one sign per lot per street frontage. Since the internal drive is not considered a public street, it would be an illegal sign. 10. The request for a temporary modular structure and a future permanent building is unconventional. Staff appreciates meeting with the applicant and development team beyond the normal half hour conceptual review meeting. These additional meetings have raised our level of comfort regarding this proposal. The Planning and Zoning Board, however, will not have the benefit of meeting informally with the development team. It is recommended that the photographs of other facilities, both modular and permanent, be presented in the form of slides to the P & Z Board, and made available for the worksession on October 16, 1992. 11. Please specify the material of the trash enclosure. r\ n410 12. Please be sure that trees are a minimum of 10 feet from the sewer main. The southerly Bradford Pear on the southwest portion of the site is very close to the sewer main serving the property. 13. Comments pertaining to the utility plans and storm drainage plans will be forwarded under separate cover. This concludes Staff comments at this time. Engineering comments will be forwarded under separate cover. In order to remain on schedule for the October 19, 1992 Planning and Zoning Board hearing, please note the following deadlines: Plan revisions are due Wednesday, September 30, 1992. P.M.T.'s, 10 prints, renderings are due Oct. 12, 1992. Final documents are due Thursday, October 15, 1992.
