Dear Mr. Brannan:
This letter is in response to your inquiry regarding the construction of a
security fence around the detention pond at the Builders Square site in the
Harmony Market planned unit development.
As you will recall , Builders Square, Harmony Market P.U.D. , Filing Two was
approved by conforming to the criteria of the Land Development Guidance System.
In addition to meeting a sufficient number of variable criteria, the P.U.D. was
required to meet the 46 absolute criteria. With proximity to residential
neighborhoods, Builders Square was carefully reviewed and evaluated by these
criteria, especially those relating to aesthetic and design features.
Quite frankly, the introduction of a security fence around the detention pond
would not meet two of the absolute criteria of the Land Development Guidance
System.
Criterion No. 33: "Does the design and arrangement of buildings and open space
areas contribute to the overall aesthetic quality of the site configuration?""
Criterion No. 43: "Does the landscape plan provide for treatment adjacent to the
building which increases the overall visual quality of the building design?"
By screening landscaping that was designed to provide a softening of the building
and enhance the streetscape, the project would not be able to answer "yes" to the
above criteria. Therefore, it is our finding that the detention pond adds a
positive element to the site and should not be fenced.
