RE: The Overlook/Seneca Center at Arapahoe Farm P.U.D.
Dear Judge Lane:
The purpose of this letter is to provide background on the review process for the above
referenced project (Seneca Center). The project was designated as Current Planning file
#55-87N and P.
The project was initially submitted to the Current Planning Department on November 25,
1996. Two neighborhood information meetings were held in conjunction with the
Preliminary. The Planning and Zoning Board granted Preliminary P.U.D. approval on
January 27, 1997.
A review of the file reveals that during the course of Preliminary review, the Current
Planning Department mailed out four letters to the affected property owners. All four
letters indicate that "retail" would be one of the land uses offered by the center. In
addition, the published agenda for the January 27, 1997 Planning and Zoning Board
meeting indicates that the request included a retail component.
The Seneca Center was granted Preliminary approval as a Neighborhood Convenience
Shopping Center. As such retail services are an allowable use.
The project was submitted to the Current Planning Department for Final P.U.D. on
September 14, 1999. The letter to the affected property owners advertising the Planning
and Zoning Board public hearing again indicated that "retail" would be an allowable use
within the center. Final P.U.D. approval was granted by the Planning and Zoning Board
on May 18, 2000.

The City's Land Use Code defines Retail Establishment as follows:
"Retail establishment(also known as retail store) shall mean an establishment of
twenty-five thousand(25,000) square feet or less of gross leasable floor area in
which sixty (60) percent or more of the gross floor area is devoted to the sale or
rental of goods or merchandise to the general public for personal or household
consumption or to services incidental to the sale or rental of such goods or
merchandise."
The Zoning Department has consistently interpreted a"liquor store" to be a "retail
establishment." The Current Planning Department concludes, therefore, that a liquor
store is a retail use that is allowable in a neighborhood convenience shopping center such
as Seneca Center.
