Dear Ted,
As you know, we have been working diligently to accommodate changes to our Preliminary P.U.D. design. The
main issue remains the alignment and design of the southern access to our property and to the parking area at the
Cathy Fromme Open Space. The new design of this access includes a desire to bury the Poudre Valley REA
power line which currently lies on the south side of the old Harmony Road easement. In an attempt to provide
these changes, we have been working with various people from city staff, Poudre Valley REA, and J.D. Padilla
(owner of Harmony Ridge). We have had a number of one-on-one meetings with these people and have met as a
group on three different occasions; the final meeting taking place today.
To date, the issues remain unresolved. I have no desire to waste time and money for both the city and ourselves
by resubmitting a plan which we know will not work. Rather, I would prefer to wait, resolve the issues, and
resubmit a plan which will be satisfactory to both of us. To that end, we request a 60 day extension to the
re-submittal deadline. Obviously, we will resubmit as soon as possible.
Please rest assured that I am working diligently on this project. Overlook Development Company, LLC desires
to sell the property and currently has it under contract. The contract stipulates that the property have Final
P.U.D. approval before it closes. Obviously, we want to expedite things to get to the closing table.
