RE: Harmony Ridge P.U.D.
Dear Steve,
This is a follow-up letter to our conversation of this morning. As we discussed, Overlook
Development Company is vehemently opposed to allowing final P.U.D. approval of Harmony
Ridge without a final solution to the Seneca Street entrance. I will try to explain our position.
For the past two years the Harmony Ridge owners and Overlook Development Company (owner
of the neighborhood convenience center) have been trying to work out a mutually acceptable
agreement for the extension of Seneca Street through the Overlook site. Early on we believed
that we had an agreement and proceeded through our Preliminary P.U.D. under that assumption.
Since that time things have fallen apart, been put back together, and fallen apart again on a
number of occasions. Because our position has never deviated from our original agreement with
the Harmony Ridge owners, we are very frustrated with what has transpired.
I have had a number of discussions with you and other city staff members about this matter. Our
last discussion was on May 4th at Wheeler's conceptual review meeting for Poudre Ridge. At
that time I was assured that final P.U.D. approval would not be given to Harmony Ridge without
a total resolution of the Seneca issue. However, last week I was informed by Gib Elkins that the
city is proceeding with final approval for Harmony Ridge, allowing a temporary access along Old
Harmony in lieu of Seneca Street. Having the city take this position may severely handicap our
negotiations. We need to resolve the Seneca issue once and for all and the P.U.D. approval time
pressure seems to be bringing the Harmony Ridge owners to the table.
If approval is granted to Harmony Ridge without ultimate resolution of the Seneca issue, our
preliminary P.U.D. is put at risk. Without a binding agreement there exists the possibility that the
Harmony Ridge owners may yet again walk away from the negotiations. If that happens,
Overlook Development Company may not receive the south half of Harmony Road and adequate

access to our site; two of the major issues which need to be resolved with the Harmony Ridge
owners.
Yet again, I believe that we are close to an agreement with the Harmony Ridge group. Since my
conversation with you this morning, I have received a 14 page agreement from Harmony Ridge's
counsel. I believe that we are within two to three weeks of a final resolution and beseech the city
not to jeopardize the talks by allowing final approval before the ultimate Seneca resolution.
Clearly, the Harmony Ridge owners, the Overlook owners and the city will benefit from a final
solution to the Seneca problem. No doubt you are hearing the Harmony Ridge side of the Seneca
negotiations. If you would like, I would welcome the opportunity to present our side to you. In
the mean time, if you have any input, please give me a call.
I request that you keep me informed about discussions between the city and Harmony Ridge
owners and please do not allow final P.U.D. approval for Harmony Ridge without our input.
