Dear Board Members;
In an effort to better coordinate the timing of the Hilburn Drive Vacation with the
required physical improvements in that area, City Staff had proposed that the owner of the
Arapahoe Farm Townhomes process an Administrative Change to request a modification of
one of the conditions of approval for that development. The request would have tied the
vacation of Hilburn Drive to the issuance of the first Certificate of Occupancy rather than the
first Building Permit, as stated in the approved condition. City Staff has now determined that
this is not the correct approach to dealing with their concerns regarding the improvements and
vacation of Hilburn Drive. The James Company therefore is requesting that the Administrative
Change be withdrawn from consideration.
It is our understanding that the Second Reading of the Hilburn Drive Vacation will now
proceed in a timely manner; and that the development can proceed as approved by the
Planning and Zoning Board.
