RE: Bike Path Gates/Overlook 4th Filing P.U.D.
As you are aware, the Gates 4th Filing P.U.D. and Overlook 4th Filing P.U.D both include a five
foot wide bike/pedestrian path that links Taft Hill Road to Webber Junior High School. This path
is slightly meandering and one-half mile in length. An underpass will allow a below-grade
crossing of the re-aligned Harmony Road.
During the review of these two P.U.D.'s, there was considerable discussion about the width of the
path being only five feet. Staff was concerned that five feet was insufficient to allow traffic to
pass in opposite directions and to carry the expected volumes for both Webber Junior High and
Johnson Elementary Schools.
The Planning Department negotiated with the developer, Gary Berger, Woodcraft Homes,in an
attempt to widen the path to seven feet. The developer refused and challenged the Planning
Department's legal authority in widen from five to seven feet.
Consequently, in discussions with Parks and Recreation and Engineering, it was decided that the
additional two feet of width could be provided by City funds in order to promote recreation and
transportation objectives.
Parks and Recreation and Engineering each agreed to contribute to the funding of one foot of
extra width with the result of adding two feet of width to the five foot path. The seven foot wide
path will, therefore, be jointly funded by the developer(five feet),Parks and Recreation(one foot)
and Engineering(one foot).
