Dear Kerrie;
It appears that a number of statements in your November 30th letter regarding the
westerly section of Hilburn Drive are not correct.
We are well aware of the statements you and Mike Herzig made at conceptual
review. You should also recall we stated at the same conceptual review
meeting that we did not agree that it was this property owner's responsibility
to remove the portion of Hilburn Drive in question.
- On July 12, 1993 a request for an administrative change for Milestone Drive
in the Sunstone PUD was made. This request was denied on the basis that the
City of Fort Collins never allows streets to be stubbed to the rears of lots as
requested without a public turn around at the end. When I asked you about the
stub at Hilburn, you replied that that situation was a mistake.
- According to G. T. Land, the Hilburn street stub was not specifically planned
in coordination with them. Their understanding was only that Arapahoe Farm
would have the option (not the obligation) to connect to Hilburn. It was not
communicated to them that Arapahoe Farm would be required to vacate and
demolish Hilburn if the connection were not made. G. T. was also surprised
that Hilburn was redesigned and reconstructed "so that grades would work
properly for the street to be extended onto the G. T. parcel" when the finished
street stub sits more than three feet below the existing grade at Arapahoe.
The bottom line is that a portion of Hilburn Drive that should not have been built, has
been completed with Regency Park. It is City Staff's position the developer of the adjacent
property is responsible for the vacation and removal of the subject street. The adjacent
property owner and the developer do not agree.
