Max,
No. 4 in the Commitment to Provide Water Service is not intended to imply that ELCO is unable to
serve Montava until the NEWT-3 pipeline is in place. ELCO currently has, and will have at the time
service is activated, adequate water treatment and transmission capacity in place to serve Montava
without the construction of the NEWT-3 pipeline.
Our concern is a matter of logistics with what ELCO staff has been told through the City of Fort
Collins development review process. ELCO staff has been told that Montava is proposing to
perform a significant amount of work in and around the intersection of North Timberline Road and
Mountain Vista Drive. This proposed work has the potential to cause an extended shutdown of the
ELCO/North Weld co-owned 24-inch water line extending east from the intersection.
If those communications are correct, it appears that Montava may request a temporary shut-down of
the existing 24-inch line in Mountain Vista. ELCO and North Weld co-own and share capacity in
this line. Co-ownership of this existing 24-inch water line in Mountain Vista Drive begins at North
Timberline Road and continues to the Larimer-Weld County line. If this water line were to be shut
down for an extended period due to work in and around the intersection, ELCO’s ability to provide
water service to areas east of that point would be significantly reduced. The co-owned 24-inch water
line is also a very vital transmission line that delivers water to North Weld, and, as such I highly
encourage Montava to communicate with North Weld regarding any intended construction that
would require a temporary shutdown on their system.
The impact on continued use of that line would have to be considered by ELCO in any request to
approve construction around the intersection of North Timberline Road and Mountain Vista Drive
that will likely impact the 24-inch water line in Mountain Vista. And, while I cannot speak for
North Weld, I would expect that it will have the same or greater concerns, as I stated above. For
any approval that would require an extended shutdown to occur, the NEWT-3 water line will need to
be in place prior to any planned shutdown.
We understand that engineered solutions to the challenges in and around the intersection may exist
that could mitigate or offset the need for the completion of the NEWT-3 line as it relates to this issue
and ELCO is willing to work with Montava in an effort to evaluate such potential solutions.
If, however, a solution to the issues in and around the intersection is not available, ELCO will be
forced to look to the completion of the NEWT-3 project, such that ELCO’s system will be better
positioned to tolerate an extended shutdown of the 24-inch water line in Mountain Vista. That
possibility is what No. 4 in the Commitment to Provide Water Service is intended to cover.
As you are well aware, ELCO and North Weld are working diligently to get the NEWT-3 project
designed and constructed as quickly as possible. As I’m sure you are also aware, we are now faced
with new potential regulatory hurdles, which were not previously anticipated, with both the City of
Fort Collins and Larimer County in the form of 1041 regulations that have changed or are in the
process of being developed.
We are now and will continue to work with City of Fort Collins Staff as they develop their 1041
regulations, but there is still a degree of uncertainty regarding the 1041 permitting for the NEWT-3
project. The City has previously approved the NEWT-3 SPAR application and issued a permit, but
the potential still exists that the project could be drawn back into a City 1041 review.
On the Larimer County side, ELCO and North Weld have submitted the NEWT-3 1041 application
and await feedback from County Staff.
We recognize that that this issue will require additional discussion and coordination as both the
NEWT-3 and Montava projects progress.
ELCO representatives, and I would think North Weld as well, remain willing to meet with
representatives from Montava to attempt to work through these challenges.

Mike this is a radical departure from any previous conversations. It has never been indicated to us
that ELCO was unable to serve Montava until the Newt line was in. Never.
Please give us details of exactly what has transpired to make this reality happen.
