We have put considerable time, effort and dollars into properly identifying the landfill area prior to submitting the original master plan. We have again reviewed this and are confident that the parcel 1-E label of 3.5 acres is correct. Perhaps a brief history of the area will assist the planning staff and the concerned citizen. The following is from the Larimer County Public records (copies of which are attached). 1. Quit Claim Deed from Stanley Walker to Larimer County (February 20, 1931) center line of old Harmony Road described in Book 599, Page 548. 2. Quit Claim Deed from Grace Walker Larimer County (February 1952) creating road and landfill area, Book 926, Page 331. 3. Resolution of Conveyance Larimer County (May 3, 1972) retained 60 foot right-of-way for existing Harmony Road and 120 foot right-of-way for Taft Hill Road from landfill area, Book 1494, Page 623. 4. Quit Claim Deed Larimer County to Jessie Aranci (May 3, 1972) gave remainder of landfill and old Harmony Road right-of-way to Aranci, Book 1494, Page 623. 5. Deed to Larimer County from Jessie Aranci (May 3, 1972) additional 60 foot right-of-way to north property line, Book 1494, Page 624. RBD Engineering has drawn the attached diagram from the legal description within these documents which illustrates how this puzzle goes together. Please note that items 3 and 4 are the document you sent which the affected property owner thought represented a 5.92 acre tract for the landfill. In actuality it was the vacated road right-of-way which created the larger parcel. • • May 7, 1991 Page --2 We also had Stewart Environmental Consultants, Inc. review their records to reconfirm the exact location of the landfill. Stewart handled the initial investigations and capping of the landfill area in 1983184. Please see the attached letter from Stewart. The landfill area was identified by subsurface investigation prior to the permanent capping of the area. We believe that we have thoroughly investigated this issue and are confident that the master plan is correct, as are the lot lines on the preliminary plan. Please let us know if you have any additional comments or concerns. We would appreciate your letting the affected property owner know the resolution of this matter. We understand that the City of Fort Collins is concerned that Parcel 1-E of the Arapahoe Farm Master Plan does not encompass the entire previous landfill site. Based on a review of our records, we have concluded the following: 1. The limits of the property actually used as the old landfill were determined by a subsurface investigation performed in 1983 by Empire Laboratories, Inc. 2. The area of the landfill situated north and east of the Harmony Road and Taft Hill Road rights -of -way was determined to be a triangular parcel consisting of approximately 3.5 acres and having the dimensions shown on the attached drawing. The hypotenuse of this triangular shape appears to coincide with the approximate south boundary of the previous road right-of-way traversing the property. The discrepancy between the area described herein and that described in a previous property transfer from the County may be that the previous description could have included this road right- of-way. In any event, it is our opinion that the actual area used for the landfill did not include this additional area as substantiated by the aforementioned subsurface investigation.
