Enterprises 1136 E. Stuart St. #4207 Fort Collins, CO 80525 OWNER: William Strickfaden 4212 Wellington Drive Fort Collins, CO 80526 PROJECT DESCRIPTION: This is a request for a one year extension of final PUD approval for a 2,604 square foot convenience store with gasoline sales and a 10,672 square foot retail building. The site is 1.78 acres in size and is located at the southwest corner of Conifer Street and Lemay Avenue. The zoning is R-L-M, Low Density Multiple -Family. RECOMMENDATION: Approval with conditions EXECUTIVE SUMMARY: This one year extension request presents no specific problems for City agencies or outside utilities. Staff is recommending approval of the extension, until March 28, 1995 with the following conditions: 1. All streets, utilities and drainage improvements be constructed or installed to City standards at the time of construction, including erosion control criteria. If necessary, the utility plans, drainage report and plans, and soils report shall be revised or updated to meet City standards at the time of construction. 2. No site work can begin until all required plans are revised and approved by the appropriate department and any necessary bonds have been posted. COMMUNITY PLANNING AND ENVIRONMENTAL SERVICES 281 N. Background: The surrounding land use and zoning are as follows: N: RLP; existing single family (Evergreen Park 2nd) S: RLP; existing single family E: FA-1; existing single family (Larimer County) W: RLM; undeveloped (regional detention pond) This site is platted as Lots 18 and 19 of Evergreen Park Third Filing Subdivision, approved in 1977. The final PUD for North Lemay Plaza was approved by the Planning and Zoning Board on March 28, 1988. According to the LDGS, final plans are in effect for three years unless the project is begun and "substantially complete". The LDGS defines "substantially complete" as all engineering improvements (water, sewer, streets, curbs, gutters, street lights, fire hydrants and storm drainage facilities) being installed and completed. Failure to make the improvements within the specified time period causes forfeiture of the right to proceed. Two six- month administrative extensions, and two one-year Planning and Zoning Board extension have been previously granted. The current extension expires on March 28, 1994. There has been no construction activity on this site. 2. Land Use: The project achieved a score of 50% on the Auto Related and Roadside Commercial Point Chart when it was approved at Preliminary on October 26, 1987. The proposal received credit for not being at two arterial streets, mixed use, energy conservation and for having contiguity to existing urban development. Staff reviewed this project against the Neighborhood Convenience Shopping Center Point Chart for the previous extension request and found that the project achieves a score of 68%, which exceeds the 65% requirement. Points were awarded for being on a transit route; being located at the intersection of a collector and arterial with primary access off of the collector; for mixed use; for being at least .75 miles from an existing or approved convenience center or store; for contiguity to existing urban development; for being located in north Fort Collins; and for energy conservation. • • North Lemay Plaza P.U.D. - Extension Request, #57-87 March 28, 1994 P & Z Meeting Page 3 3. Desicgn• The convenience store is oriented toward the interior of the site. Customer parking, gas pumps and gas canopy are located away from Conifer and Lemay and are shielded by perimeter landscape treatment. The short axis of the canopy is parallel to Lemay to minimize the exposure to Lemay Avenue. The convenience store structure is to be built of brick with a sloped roof of wood shake shingles. The Residential Neighborhood Sign District went into effect January 15, 1993. This district is intended to regulate signs for non- residential uses in areas of the City which may be affected by such signs because of their predominantly residential use and character. The provisions of the district apply to neighborhood service centers, neighborhood convenience shopping centers, business service uses and auto related and roadside commercial uses in the district which are developed on or after January 15, 1993. Signage for this site will be reviewed against the Sign Code regulations of the Residential Neighborhood Sign District. 4. Utilities: The request for an extension has been reviewed by all affected City agencies and outside utilities. The Engineering Department and the Stormwater Utility request that all streets, utilities and drainage improvements be constructed or installed to City standards at the time of construction, including erosion control criteria. If necessary, the utility plans, drainage report and plans, and soils report shall be revised or updated to meet City standards at the time of construction. The Erosion Construction Criteria, adopted in 1991, must be adhered to with all new construction. Any revisions or updates to utility plans, drainage report and plans. etc. must be provided to meet current City standards at the time of construction. In addition, no site work can begin until all required plans are revised and approved by the appropriate department and any necessary bonds have been posted. Columbine Cablevision has informed us that construction on Lemay and Conifer will likely cause service disruption to their customers north of Conifer Street. Columbine Cablevision has four major trunk lines along the north, east and south sides of this site. 0 North Lemay Plaza P.U.D. - Extension Request, #57-87 March 28, 1994 P & Z Meeting Page 4 RECOMMENDATION Staff finds that there are no significant issues related to the request for a one year extension of North Lemay Plaza PUD. The approved plan continues to meet the All Development Criteria of the Land Development Guidance System and meets the criteria of the Neighborhood Convenience Shopping Center and the Auto Related and Roadside Commercial Point Charts. Therefore, staff recommends approval of the one-year extension of the final approval of North Lemay Plaza PUD Final, #57-87B, to March 28, 1995 with the following conditions: 1. All streets, utilities and drainage improvements be constructed or installed to City standards at the time of construction, including erosion control criteria. If necessary, the utility plans, drainage report and plans, and soils report shall be revised or updated to meet City standards at the time of construction. 2.
