HomeMy WebLinkAboutNORTH LEMAY PLAZA PUD - ONE YEAR EXTENSION OF FINAL APPROVAL - 57-87B - REPORTS - RECOMMENDATION/REPORTITEM NO. 11 MEETING DATE 3/ 2 3/ 9 2 STAFF Kirsten Whetstone City of Fort Collins PLANNING AND ZONING BOARD STAFF REPORT PROJECT: North Lemay Plaza PUD- One Year Extension of Final Approval- #57-87B APPLICANT: William Strickfaden, CCIM Strickfaden and Associates Inc. 4212 Wellington Drive Fort Collins, CO 80526-5231 OWNER: RANJEB, Inc. c/o Strickfaden and Associates Inc. 4212 Wellington Drive Fort Collins, CO 80526-5231 PROJECT DESCRIPTION: This is a request for a one year extension of final PUD approval, for a 2,604 square foot convenience store with gasoline sales and a 10,672 square foot retail building. The site contains 1.78 acres, and is located at the southwest corner of Conifer Street and North Lemay Avenue. The zoning is R-L-M, Low Density Multi -Family. RECOMMENDATION: Approval with conditions EXECUTIVE SUMMARY: This one year extension request presents no specific problems for City agencies or outside utilities. Staff is recommending approval of the extension, until March 28, 1993, with the following conditions: 1. All streets, utilities, and drainage improvements be constructed or installed to City standards at the time of construction, including the construction erosion control criteria. If necessary, the utility plans, drainage report and plans, and soils report shall be revised or updated to meet City standards at the time of construction. 2. Background• The surrounding land use and zoning are as follows: N: R-L-P; Single family residential S: R-L-P; Single family residential E: FA-1; (County); Single family residential W: R-L-M; Vacant (City Regional Detention Pond) The site consists of Lots 18 and 19 of Evergreen Park Third Filing Subdivision, approved in 1977. The final PUD for North Lemay Plaza was approved by the Planning and Zoning Board on March 28, 1988. According to the LDGS, final plans are in effect for a period of three years unless the project is "begun and substantially complete". The LDGS defines "substantially" complete to include that all engineering improvements (water, sewer, streets, curbs, gutters, street lights, fire hydrants and storm drainage) be installed and completed. Failure to make the improvements within the specified time period causes forfeiture of the right to proceed. Two six month administrative extensions have been previously granted. The current extension expires on March 28, 1992. There has been no construction activity on this site. 2. Land Use: The project achieved a score of 50% on the Auto Related and Roadside Commercial point chart when it was approved at preliminary on October 26, 1987. The proposal received credit for not being at two arterial streets, for mixed use, for exceeding the Model Energy Code by 39%, and having contiguity to existing urban development. Staff reviewed the project against the Neighborhood Convenience Shopping Center point chart for the current extension request and found that the project achieves a score of 68%, which exceeds the 65% requirement. The proposal receives credit for being on a transit route, for being located at the intersection of a collector and arterial street with primary access off of the collector, for mixed use, for being located at least .75 miles from any existing or approved Neighborhood Convenience Shopping Center or store, for contiguity to existing urban development, for a location in "north" Fort Collins, and for exceeding the Model Energy Code by 39% (verified by the Building Department prior to final approval in March 28, 1988). North Lemay Plaza PUD - One Year Extension, #57-87B March 23, 1992 P & Z Meeting Page 3 3. Site Design - The orientation of the convenience store is towards the interior of the site. The customer parking, store entrance, gas pumps and gas canopy are pulled away from Conifer and Lemay and shielded by perimeter landscaping. The short axis of the canopy is parallel to Lemay to minimize the exposure to Lemay Avenue. The convenience store building is softened by the 4 foot landscaped berm on the exterior walls facing Conifer and Lemay. The building itself is brick with a sloped roof featuring wood shake shingles. The setback off Lemay would be 49 feet and the setback off Conifer would be 45 feet. The retail building would be setback off Conifer by 40 feet. The architecture would match the convenience store and feature brick, sloped roof, and wood shake shingles. The street frontage is heavily landscaped with deciduous and ornamental trees and shrub beds. The area between the retail building and the City detention pond, on the west property line, is well landscaped with a variety of pine trees and deciduous shrubs. The south property line contains existing mature cottonwoods and an irrigation ditch. The existing trees will remain and the area of the ditch will feature a berm and additional trees and shrubs. 4. Utilities: The request for an extension has been reviewed by all affected City agencies and outside utilities. The Engineering Department and the Stormwater Utility request that all streets, utilities and drainage improvements be constructed or installed to City standards at the time of construction, including the construction erosion control criteria. If necessary, the utility plans, drainage report and plans, and soils report shall be revised or updated to meet City standards at the time of construction. Construction erosion control criteria, adopted in 1991, must be adhered to with all new construction. Any revisions or updates to utility plans, drainage report and plans, etc. must be provided, to meet current City standards at the time of construction. In addition, no site work can begin until the revised plans are approved by the appropriate Department and any necessary bonds have been posted. Columbine Cable has informed us that construction on Lemay and Conifer will likely cause major service disruptions to their customers north of Conifer Street. Columbine Cable has four major trunk lines along the north, east, and south sides of this project. Prior to construction, coordinate your schedule with Columbine Cable. They may also request that the developer notify affected customers about any service disruption. • North Lemay Plaza PUD - One Year Extension, #57-87B March 23, 1992 P & Z Meeting Page 4 RECOMMENDATION Staff finds that there are no significant issues related to the request for a one year extension of the North Lemay Plaza PUD. The approved plan continues to meet the criteria of the All Development point chart, still meets the criteria of the Auto Related and Roadside Commercial point chart, and was found to meet the criteria of the Neighborhood Convenience Shopping Center point chart of the LDGS. Therefore, staff recommends approval of the one year extension of final approval for the North Lemay Plaza PUD Final, #57-87B, to March 28, 1993 with the following conditions: 1. All streets, utilities, and drainage improvements be constructed or installed to City standards at the time of construction, including the construction erosion control criteria. If necessary, the utility plans, drainage report and plans, and soils report shall be revised or updated to meet City standards at the time of construction. 2.
