After reviewing the several pieces of correspondence regarding the Noel Annexation
proposal, it appears that further clarification is needed regarding the County's
position. Annexation of the Noel property is required by the recently adopted
Intergovernmental Agreement. Policy 1.6 states that the City will annex all
property in the Urban Growth Area when it becomes eligible for annexation.
Paragraph 2.5 A" states that the County will not accept any development application
which is eligible for voluntary annexation. The Noel property is eligible for
voluntary annexation.
Since the property is in the UGA and is eligible for annexation, the proposal is
supported and recommended by the County Planning Staff, the Planning Commission,
and the Board of County Commissioners. If annexation does not occur, it places
this property owner in an untenable position for future land use applications.
The County is confident that other issues relating to this annexation will be
resolved pursuant to the spirit and intent of the Intergovernmental Agreement.
