Dear Ralph and Cheryl:
It is the determination of the Planning Staff that we can proceed with the
combined preliminary/final PUD plan for the Forney House if specifications
regulating outdoor activities are noted directly on the site plan itself,
thus becoming legally binding with the approval of the PUD. In order for
this proposal to go to the November 16 Planning and Zoning Board, I must
have a newly revised site plan incorporating those stipulations by the end
of the day Wednesday, November 4.
Please create directly on the site plan a block of notes entitled "Outdoor
Activity Restrictions". The following stipulations are to then be listed:
1. Hours of outdoor activity are limited to 9:00 AM to 7:00 PM.
2. The number of outdoor activity attendees will not exceed 100.
3. No amplified music will be permitted.
4. Outdoor events will not exceed 2 (two) per week.
5. These restrictions will again be reviewed by the Planning and Zoning
Board at the regular November 1988 hearing. This applicant'or existing
other owner must apply for consideration prior to the November 1988
filing deadline, or the outdoor activity feature of this PUD will be
automatically expired.

In addition to these restrictions on outdoor activities, there are still a
number of outstanding engineering concerns. The requirements listed below
must also be shown directly on the site plan in graphic or notational form:
1. The platted alleyway right-of-way is 20 feet. The alley must be paved
from point of entry to 10 feet south of the last parking stall. A
cross-section of the paving and soil report for pavement design are to
be included. Alley pavement may be either concrete or asphalt.
2. Handicapped access ramps are to be installed at the southwest corner of
West Olive and Grant Streets. This is to be shown on the site plan.
Again, details of the ramps, curb and gutter must be submitted.
3. Standard construction notes are required on the utility plan.
4. Signature blocks for the City Engineer and other utilities on the util-
ity plan are required. Also, a signature block for the Secretary to the
Planning and Zoning Board is required on the site plan.
5. A separate utility plan for utility and alley improvements is sug-
gested.
I hope this resolves the last of our outstanding concerns. The reason these
changes must be made immediately is so I can write a staff report with a
positive recommendation. As I have said before, the staff policy is not to
approve final plans subject to conditions.
