PROJECT DESCRIPTION: Request for Out-of-City water service for a future
single-family home to be located at 3930 Bingham Hill Road.
RECct1MENDATION: Staff recommends approval of the Out-of-City water service
request on the condition the property owner signs the standard Out-of-City
Utility Agreement including the annexation clause.
EXECUTIVE SUMMARY: This is a request for Out-of-City water service for a
future single-family home to be located at 3930 Bingham Hill Road. The
property is presently undeveloped.

COMMENTS:
1. Background:
The applicant and property owner, Reid D. Pope has submitted a written
request for Out-of-City water service (see attached letter of November 2,
1987) for a single-family home to be located at 3930 Bingham Hill Road. The
property is presently undeveloped but, the owner plans to construct a new
single-family on the 20 acre site.
Out-of-City utility requests require approval by the City Council. Appli-
cations are submitted to the City's Water and Sewer Department. The appli-
cation is reviewed by the Water Board for technical service issues and the
Planning and Zoning Board for land use issues. Each board forwards a rec-
ommendation to the Council. The Water Board approved the request at their
meeting on November 20, 1987.
The property is located outside of the Fort Collins Urban Growth Area but,
the City is the only potential water service agency. No other water util-
ity is able to provide water service to the site. The site is located in
an area designated as an Urban Reserve Area on the proposed Larimer County
Land Use Plan. The City has had no problems with the Plan's Urban Reserve
designation for this area. An urban reserve is an area which may became
urbanized in the future as urban services eventually become available.
Development within the urban reserve is to be of a nature which would allow
for redevelopment or conversion to urban land uses in the future. Staff
feels the 20 acre parcel would be in line with the purposes of the urban
reserve designation.
It has been City policy to require the inclusion of an annexation agreement
as part of the Out-of-City utility service agreement. Although the prop-
erty is located outside of the UGA boundary at the present time, the area
may become urbanized and a part of the City of Fort Collins in the future.
RECOMMENDATION:
Staff recommends approval of the Out-of-City water service request on the
condition the property owner signs the standard Out-of-City Utility Agree-
ment including the annexation clause.
