Mr. Shepard replied that the City of Fort Collins was looking at a Community
Horticultural Center. There is a citizens group that has approached the Council about
integrating City resources as well as private sector resources. He did not believe a site
had been agreed upon. Mr. Shepard stated that he did not think the applicant wanted
to provide that kind of amenity on this site.
Member Walker appreciated the concepts being put forth in this project. The alley's,
the density, detached sidewalks, and the sense of a more pedestrian friendly
environment.
Member Mickelsen asked about the water table issues in the area.
Glen Schlueter responded that the drainage in the area would not have any affect on
the high ground water.
Member Strom commented that the Community Horticulture idea was interesting, but
under the circumstances, the property owners have brought them a proposal, and the
Board has to deal with the proposal in front of them. Mr. Strom agreed with the findings
of fact and conclusion as presented in the staff report.
Member Strom moved for approval of Overland Ridge, Preliminary PUD with the
one condition attached regarding Lots 22-26.
Member Mickelson seconded the motion.
Member Colton stated he would be supporting the motion and thought there were a lot
of good concepts and appreciated some of the comments made by residents.
Member Walker commented that changing the status of Elizabeth was not precluded
with this project. Mr. Walker suggested that the residents might want to stay involved
and get into some discussions with the City regarding the future of Elizabeth Street.
Member Walker felt all the criteria was satisfied and would be supporting the motion.
The motion was approved 5-0, with Chairperson Carnes and Member Davidson
not voting due to a conflict of interest.
Gateway at Harmony Road PUD - Taco Cabana - Preliminary and Final, #1-88H.
Steve Olt, Project Planner gave the staff report recommending approval with the
standard final approval condition with regards to final utility plans and development
agreement.

Member Walker asked about the palm trees on the side of the building and why were
they not considered signage?
Mr. Olt replied that staff did not feel that just being on the one wall, that the-trees
become the sign, they don't become the corporate logo in this case.
Member Walker thought that it added a certain amount of visual clutter, and asked if
there were any other examples.
Mr. Olt replied staff has looked at graphic representation and artwork that in some
cases have been considered signage, but that was a Zoning Department issue.
Member Walker asked if there would be a ground sign on College Avenue.
Mr. Olt replied that there was a monument sign on College Avenue, that staff does not
review, and the Zoning Department would handle that phase.
Member Colton asked if there was any landscaping on the south side of the parking lot
for Taco Cabana and McDonald's.
Mr. Olt replied that there was existing landscaping on the McDonald's site. Staff felt
that it was more important to get pedestrian movement, and there is landscaping that
separates the two parking lots, and is on the McDonald's side. Mr. Olt referred to a slide
for the Board to examine.
Member Colton asked what the height would be compared to the other buildings in the
area.
Mr. Olt replied that it would not be out of character with the other buildings in the center.
Member Davidson asked if there was something in the code regarding backlit awnings.
Mr. Olt replied that these were not backlit awnings.
Member Davidson saw these as the same things, with the lighting on the top shining
down on the awnings.
Mr. Olt replied that the lighting is the same thing that just about every restaurant has
with armed fixtures hanging down.

Linda Ripley, Ripley and Associates, gave the applicant's presentation. She spoke of
the Taco Cabana Corporation, the color of the building, landscaping, fencing, and the
street frontage along College Avenue. Ms Ripley stated that they were not proposing
neon and have taken the palm trees off of the awnings.
Member Bell asked for clarification of the colors.
Ms. Ripley reviewed the colors of the building and awnings.
Member Bell asked about the joint parking.
Ms. Ripley pointed out the location of the sidewalk and the planter that splits the
property.
Member Bell asked about pedestrian access.
Ms. Ripley reviewed the site plan and the pedestrian access, and that Taco Cabana
was working with McDonald's to obtain additional joint parking in a lot to the west for
employee parking.
Member Davidson asked what the length of the street frontage on College was.
Ms. Ripley replied 115.63.
Member Davidson asked about the trees on the street frontage.
Ms. Ripley reviewed the street trees on the site plan.
Member Davidson asked what the square footage was of the proposed parking lot and
would there be landscaped islands.
Ms. Ripley replied that that parking lot was not part of this proposal and had already
been approved as a parking lot and the landscaping would have been approved as part
of that proposal.
Mr. Olt added that there were two parking areas as part of the M & 0 Tire PUD
approval six months ago. The whole parking area was approved.

Member Bell asked for clarification on the point chart for #D, 2 acres or more.
Mr. Olt responded that the site itself is 1.0 acre, but to be consistent with everything
else approved the site was looked at as a whole.
Director Blanchard added that the Gateway at Harmony Road PUD was approved in
1989, a 4.5 acre site that identified a number of different uses, which would not allow
any of the uses to come in over 2 acres. Mr. Blanchard felt it was appropriate that if a
PUD anticipates four or five sites, and is only 4 acres in size, you would not get
individual projects that exceed 2 acres.
Deputy City Attorney Eckman concurred that the points could be properly awarded.
Member Colton asked to see a north elevation.
Mr. Olt reviewed the north elevation and the landscaping for the Board.

Member Bell asked about the elevations and a portion seemed to be higher.
Mr. Olt replied that was correct and pointed out the tower element above the main entry
to the building on the south side. This was done to break up the long horizontal line of
the building. The tower gives it a vertical element which staff feel improves the
appearance.
Member Bell asked about the actual height of the building.
Ms. Ripley replied the building was 18 feet before the tower was added and that was 4
feet higher, so 22 feet.
Member Walker moved for approval of the Taco Cabana PUD, including the staff
conditions.
Member Mickelson seconded the motion.
Member Walked commented that the proposal was reasonable and the applicant was
working with the general theme of the Gateway at Harmony PUD. He liked the
landscaping also.
Member Davidson also liked the landscaping, but did have some concerns about how
we interpret signage.

The motion was approved 6-1, with Member Bell voting in the negative.
Timberline Farms P.U.D. - Diamond Shamrock Cornerstore - Preliminary, #42-89C.
Member Strom removed himself due to a conflict of interest.
Ted Shepard, Senior Planner gave the staff report recommending approval.
Mr. Shepard also pointed out that there was a request for a variance from the point
chart and that was to be voted on separately, before the main motion.
Member Mickelson asked if the canopy color was the same color discussed in the
worksession.
Mr. Shepard replied yes.
Chairperson Carnes asked what the status of the Overall Preliminary PUD for the
Harmony School Shops Shopping Center.
Mr. Shepard replied it was on the agenda for the December 18th Planning and Zoning
Board Hearing.
Rick Gibson, Real-Estate Representative for Diamond Shamrock, gave the applicant's
presentation.
Dave Jones, Galloway, Romero & Associates, consulting engineers representing
Diamond Shamrock gave a description of their project. Mr. Jones spoke on the
location, access to the project, shared access with the adjoining shopping center, the
elevations, accent blocks on the building, brick to match the Harmony School, the split
canopy, the similar features of the carwash, and the color of the canopy. Mr. Jones
discussed the variance request for the point charts.
Member Mickelsen asked why the canopies over the pumps could not have the same
shape as the school. It was a drastic contrast and was not very compatible.
Member Davidson commented that perpendicular rooftops would make the design a
whole lot better and more compatible. He felt they overpower the main building.
Mr. Jones responded that one of the difficulties they would have in putting a similar roof
structure on a canopy was it would be quite an immense structure. He thought that it
would overpower the site for the use of a convenience store.
