Box 580 • Fort Collins, CO 80522-0580 • (303) 221-6505 0 • LETTER OF INTENT This is written to clarify the basic elements of a proposed agreement between the City and the School District regarding construction of streets serving the 1990 school site. This proposal has been developed by the undersigned representatives of the two organizations. PROPOSAL 1. The School District will construct, at its expense, the collector street accessing the school site north from Horsetooth Road. The estimated cost of this project is $98,000. The estimated amount which would be eligible for repayment to the District under the relevant provisions of City Code is $43,000. (This assumes that there is no collateral agreement between the District and affected property owners which would preclude repayment.) 2. The City will pay to the School District $60,000 on the condition that the District will apply this entire amount to defray the cost of constructing Horsetooth Road between Taft Hill Road and the new collector street which will access the school site. The City will pay for the remainder of the cost of constructing Horsetooth Road as a 36 foot wide street with curb, gutter, and sidewalk on the north half of Horsetooth right-of-way. The total estimated cost of street construction will be $123,000. The repayments to the City and the District from future developers on the arterial are estimated at $50,000. Assuming again that the District has not relinquished its right to repayment by agreement with the property owners, the amount collected would be split equally between the District and the City. 3. This proposal has been developed specifically to address the issues of the 1990 school site. It is not intended to be used as a model for future schools. It is also understood that the School District will not be required to pay street oversizing fees as a part of the 1990 school project. Conversely, it is understood that the School District will not be reimbursed from the street oversizing fund for the cost of oversizing the collector. We feel that this proposal will help to create ai environment of compromise which will allow the City and the School District to continue discussions on the longer term issues. We have discussed several general ideas among ourselves which may, with further elaboration and discussion, form the basis for a future intergovernmental agreement.
