HomeMy WebLinkAboutEMERSON ACRES REZONING - 22-88A - CORRESPONDENCE - RESPONSE TO CITIZENDeveorent Services , Planning Department Citv of fort i:oiiins April 6, 1989 Mr. Harold Einarsen Einarsen Real Estate, Inc. 419 Canyon Suite 300 Fort Collins, CO. 80521 Dear Mr. Einarsen: This letter is clarify the City Council action regarding the zoning of the subdivision known as Emerson Acres, generally located at the northeast corner of' South Lemay Avenue and County Road #32 (Windsor Road). The Emerson Acres parcel was annexed into the City in 1984 and zoned R-L-P (Low Density Planned Residential) with the condition that development occur as a planned unit development in accordance with the Ordinances of the City of Fort Collins. The P.U.D. condition requires all development proposals to be processed according to the criteria of the Land Development Guidance System including detached, single family homes. On March 21, 1989, the City Council of the City of Fort Collins heard, on first reading, Ordinance 37-1989 which would rezone the Emerson Acres parcel from R-L-P (with the P.U.D. condition) to R-L-P (without the P.U.D. condition). The Ordinance passed on the consent agenda unanimously. On April 4, 1989, the City Council of the City of Fort Collins heard, on second reading, Ordinance 37-1989, and it passed on the consent agenda unanimously. According to the City Code of the City of Fort Collins, Ordinance 37-1989 will be legally effective ten days after passage on the second reading by Council. Therefore, on April 14, 1989, the City Engineer is authorized and directed to amend the City Zoning District Map in accordance with Ordinance 37-1989. Copies of the Ordinance are on file with the Office of the City Clerk. It is my hope that this letter clearly explains the action taken by City Council regarding Emerson Acres.
