Dear Mr. Dickinson:
As things now stand with Emerson Acres, we have an approved subdivision plat
for 5 lots. The zoning on the property, however, remains r-1-p, Low Density
Planned Residential. It is significant to note that the zoning is designated in
lower case letters. This means that there is a condition on the zoning that was
passed by the City Council on June 5, 1984 that requires all development to go
through the P.U.D. process.
This P.U.D. condition would apply for any potential lot owner in the Emerson
Acres subdivision. Considering the likelihood that the lots will develop as single
family detached homes, the Planning Department feels the requirement to go
through the P.U.D. process to be overly burdensome. Also, the Development
Agreement that covers Emerson Acres contains sufficient protection for the City
that should the property redevelop to a more intense use, then street improvements
to Lemay would be triggered.
As a result, the Planning Department would like to rezone the Emerson Acres
subdivision from lower case r-1-p (with P.U.D. condition) to upper case R-L-P in
order to delete the P.U.D. condition from the property. By rezoning to upper case
R-L-P, a potential lot owner would be able to construct a single family home as a
"use by right" rather than go through the P.U.D. process.
We think this rezoning will make life simpler for the 5 potential owners of the
lots in Emerson Acres. It would not, however, relieve any lot owner of the
conditions set forth in the Development Agreement.
The Planning Department would like to make this rezoning to R-L-P as easy as
possible for you. The Planning Department would act as petitioners. There would
be no fee. The only requirement is that you give us written permission to
proceed.
Our tentative time frame is to take the rezoning request to the Planning and
Zoning Board on January 23, 1989. Since the P & Z does not have final author-
ity (they can only make a recommendation), the request would then go to City
Council for final action on February 7, 1989.
