Temporary Service Changes - City of Fort Collins Development Review
In order to continue providing thorough reviews and giving every project the
attention it deserves, the City of Fort Collins is implementing temporary
changes in how we serve our development customers. As you may be aware,
we are experiencing staff shortages in a number of key departments, which has
begun to impact the timeliness of our reviews. We recognize that development
and construction play a critical role in our community’s vibrancy and economic
recovery, and we have been exploring options for mitigating impacts to our
customers. As a result, we will be making some temporary service changes.
Beginning Monday May 10th one additional week of review time will be added
to all 1st and 2nd round submittals (increase from 3 weeks to 4 weeks).

11/02/2021: * FOR HEARING:
This proposed project is processing as a Type 2 Development Plan. The
decision maker for Type 2 is the Planning and Zoning (P&Z) Board. For the
hearing, we will formally notify surrounding property owners within 800 feet
(excluding public right-of-way and publicly owned open space). Staff would
need to be in agreement the project is ready for Hearing approximately 3-5
weeks prior to the hearing. I have attached the P&Z schedule, which has key
dates leading up to the hearing.

Comment Number: 16 Comment Originated: 02/22/2022
02/25/2022: FOR HEARING: MODIFICATION: A modification of a standard is
needed for the building placement with a drive between the building and the
street - 3.5.3(C)(1) in conjunction with the definition of 'Connecting walkway' in
Article 5. This is a slightly confusing standard in conjunction with the
build-to-line standard below it in the code. Give me a call on this if helpful -
970.221.6225.
Response: A modification of standard is included.
Comment Number: 17 Comment Originated: 02/22/2022
02/25/2022: FOR HEARING: APU AT HEARING: I have some thoughts about
the APU request, and expect to coordinate with you on the staff report in this
regard. Considerations may include the history and reason behind the MMN
zoning, and the APU criteria for this type of APU.
Response: Thanks, let’s talk as you get closer to finalizing the staff report.
Comment Number: 18 Comment Originated: 02/22/2022
05/02/2022: Thanks for the Modification Request for the Glare rating.
02/25/2022: FOR HEARING: LIGHTING: Specific lighting requirements,
including parameters and formatting of the lighting information, are found in
Section 3.2.4. They involve a total lumen budget and BUG ratings for the
fixtures used. The full cutoff and spillover information in the conceptual lighting
plan are consistent with the purposes of the lighting standards. (I don't see a
lighting plan yet - right?)
Response: An updated lighting plan was submitted with a modification. In a meeting with Clark, he
Acknowledged receipt.

Comment Number: 21 Comment Originated: 02/25/2022
02/25/2022: FOR HEARING: SIGNS: I think it’s “cleaner” to have no signs
shown on development plans because then there’s no question about
something being approved or not. The other option is to put a note on the
elevations saying something like “signs are not reviewed or approved during
development review; requires separate sign permit”. As far as the red clip
goes, the sign measurement would be taken using that entire red face.
Response: Signs have been taken off the plans have labelled them as a separate permit.
Additionally, monument signs have been shown for reference but are noted that they are to be by separate
permit.
Comment Number: 22 Comment Originated: 02/25/2022
05/02/2022: FOR HEARING: Staff is still considering the lack of trees relative to
the numerical requirements noted in previous comments. For discussion to
have the whole story for hearing.
02/25/2022: FOR HEARING: TREE METRICS: I will work with you on a blanket
'alternative compliance' request for any numerical tree standards, and a
foundation planting standard if needed to cover any questions about that.
Response: We have provided a modification request for “full tree stocking”. Let us know if you need an
alternative compliance.
Comment Number: 23 Comment Originated: 02/25/2022
02/25/2022: FOR HEARING: BUILDING MASSING VARIATION: Similar to 22
above, a minor MODIFICATION to cover any questions about a standard
limiting horizontal building masses to a 3:1 width to height ratio. (3.5.3(D)).
Response: In discussions with Clark, we agreed a modification is not needed we are very close to the
3:1 ratio on each of the building facades. With the primary element of the façade being glass, the
Variation of massing particularly at night with the lights are on, create the appearance of exceeding
the 3:1 ratio.

Response: That is correct. Xcel has been coordinated with regarding gas relocations.

05/02/2022: FOR HEARING: Is the walkway apron area in front of each
building, useable? Perhaps the expectation is more that people will just be
walking everywhere in the parking lots? There are some dots on the site plan
near the EV charging station - what are those? And relatedly, it looks like the
EV station is in the bumper overhang area; and will make will people walk skirt
around it. Can the front area work as shown? This is related to the modification,
but we should be prepared with the whole story for the hearing.
Response: The walkway in front of Nissan is 7.5’ wide with a car overhang. The walkway in front of the
Kia building is 5’ with no vehicle overhang.
5
The walkway near the EV charging stations in front of Nissan has been widened to 9’.

05/02/2022: Q FOR FINAL: LANDSCAPE PLAN: Does everyone understand
the commitment to maintaining hundreds of shrubs? Spring pruning, a
replacement program? It looks like parking screening could perhaps be more
easily provided with fencing and fewer shrubs. Understood that code calls for
the shrub screening, and with some major gardening work it could be a rich
garden setting. I see a number of shrubs that would need major pruning.
Response: Plantings shown on the plan are consistent with the Fort Collins Landscape code and are
shown due to the code or specific comments from planning staff. Plant material shown in natural areas
have been selected to remain in a native or natural setting and will not require pruning or
maintenance. Additionally,
Xeric plant material and ornamental grasses have been used throughout the project site and are relatively
low maintenance, only required to be pruned in early spring.

Because Venus is local roadway, the Venus/College intersection is not eligible
for TCEF reimbursement.
11/02/2021: FOR FINAL PLAN
Please note that full design of College Ave., including the proposed traffic
signal, signing and striping, etc. will be the responsibility of the developer and
subject to review and approval by CDOT. The traffic signal is not eligible for
City funding and will be the full responsibility of the development.
Response: Noted, we have included signal plans, signing & striping plans, and roadway plans for the
development of the traffic signal at the intersection of Venus and College. We understand that the City
and CDOT must approve the plans. We understand that the signal will not be eligible for reimbursement.

The Letter of Intent or Agreement from the North Louden Ditch is acceptable,
however since this is in the form of a legal agreement, the developer will need to
provide the City with written notification within 3-business days in the event that
the ‘agreement’ with the North Louden Ditch Company expires.
11/02/2021: FOR HEARING: (addressed)
The realignment and undergrounding of the North Louden Ditch will require the
ditch company to sign the plans. A Letter of Intent is required before Hearing.
For final approval – the agreement with North Louden Ditch Company will need
to document Ownership and Maintenance responsibilities for relocated ditch
section.
Response: Noted. An extension to the agreement has been requested of the Ditch Company and will be

**Regarding the drainage easement through the City Natural Areas property.
Per recent discussions I understand the applicant has a desire to take this
project to Planning and Zoning Hearing without the "letter of intent" from the
Natural Areas Department. This is called an "at risk" approach and would be a
9
condition of Hearing approval.
Condition of approval: "For approval of the Final Development Plan the
developer shall obtain a drainage easement from the City Natural Areas
Department and it's governing authorities. This includes a recommendation
from the Land Conservation and Stewardship Board as well as ultimate
approval from City Council."
02/22/2022: FOR HEARING:
Follow up on comment 13 – a drainage easement will be needed through the
Natural Areas property for formalization of this drainage flow path. A ‘letter of
intent’ for this will be required before Hearing. The Natural Areas staff has
indicated that a recommendation from the Natural Areas Board will be needed
before this LOI can be written. The final easement approval is through City
Council however.
Response: We have prepared an easement application package for Natural Areas staff. Natural Areas
staff will be taking this in front of the Land Conservation Board for their initial approval on July 13th. If all
goes well at the Board meeting, we may have the LOI from Natural Areas in time for the July 21st P&Z
Hearing. We understand that ultimate approval will come from City Council.

05/03/22: FOR HEARING - UPDATED: Understanding the unique design
challenges associated with the proposed location for the Skyridge Trail, please
plan to develop a trail connectivity exhibit that identifies both a long-term and
short-term direct access connection to the Fossil Creek Trail. This exhibit will
be used to define additional needs (be it through this development, future
development, or by the City) in the final design phase.
Response: We have provided a trail exhibit.
2/22/2022: FOR HEARING: Please plan to include a preliminary level design
for the section of the Skyridge Trail as identified in the South College Corridor
Plan (SCCP) adopted March 3, 2009 by the City of Fort Collins. This trail is
located on the western portion of the property, extending from the north to south
boundary of the parcel. This trail will ultimately connect to the north to the Fossil
Creek Trail in the Redtail Grove Natural Area and provide connectivity for
southwest Fort Collins to the City’s existing trail system.
10/25/2021: INFORMATION: The South College Corridor Plan (SCCP)

CONSTRUCTION PERMIT ISSUANCE: Language regarding the protection and
enhancement of the Natural Habitat Buffer Zone will be included in the
Development Agreement for this project. A security will need to be provided
prior to the issuance of a Development Construction Permit that accounts for
the installation and establishment of the Natural Habitat Buffer Zone. Prior to the
FDP approval please provide an estimate of the landscaping costs for the
Natural Habitat Buffer Zone, including materials, labor, monitoring for a
minimum of three years, weed mitigation and irrigation. We will then use the
approved estimate to collect a security (bond or escrow) at 125% of the total
amount prior to the issuance of a Development Construction Permit.
Response: Acknowledged. We will look forward to receiving the language from you and we will work with
you on the estimate for the 125% security escrow.

Please do not propose Lindens in parking lot islands or along arterial streets.
They do not handle road deicing salts very well and these areas are tough spots
for Lindens. Thank you!
2/24/2022: FOR FINAL APPROVAL
Please propose canopy shade trees in parking lot islands. While fastigiate
trees are great for small spaces, they do not provide as much canopy cover
which is so need in parking lots to decrease the heat island effect. Thank you!
