RECOMMENDATION: Approval EXECUTIVE SUMMARY: Several PUD's & Subdivisions that have not been completed with the condition of final approval, which required that the development agreement, final plans and final plat be executed prior to the May 19, 1997 Planning and Zoning board meeting. Staff recommends that the Board modify this condition of approval, to require execution of the development agreement, final plans and final plat prior to the June 19th, 1997 Planning and Zoning Board meetings for the following projects: Hugh M. Box 580 Fort Collins, CO 80522-0580 (970) 221-6750 PLANNING DEPARTMENT • • Modifications of Conditions of Approval May 19, 1997 P & Z Hearing Page 2 Harmony School Shops, 1st Filing Shenandoah PUD, First Filing Registry Ridge PUD, Phase 1 Park South PUD, Third Replat U 0 E • • • MEMORANDUM DATE: May 12, 1997 TO: Planning and Zoning Board Members FROM: Dave Stringer, Development Engineering Manager RE: STATUS OF PROJECTS ON THE LIST FOR MODIFICATION OF FINAL APPROVAL The following is a list of 24 projects (2 Inactive, 22 Active) currently on the agenda for a one month extension of the condition of final approval requiring completion of utility plans and execution of a development agreement. A brief summary of the project status follows each item. The project list is divided into 2 categories: 1) INACTIVE - Project has not been active for 6 months or more, but the P.U.D. is within 3 years from the date of final approval granted by the Board. The utility plans and development agreement are not completed for various reasons described in the project status summary. 2) ACTIVE - P.U.D. is within 3 year approval time and the utility plan approvals and development agreement completion are currently in progress. Status is given in summary for each project. INACTIVE PROJECTS: Hugh M. Woods P.U.D. • P & Z Approval: 2/27/95 Developer notified the City on May 12, 1995 that they are no longer actively pursuing the P.U.D. on this site (Skyway Drive and South College.) Christ Fellowship Church Subdivision P & Z Approval: 11/20/95 Comments were sent to the engineer on 4/18/96. Awaiting a resubmittal from the Developer's engineer. The church had wanted final land use approvals but is not prepared to build immediately and so it is assumed this is why the applicant has not pursued the project recently. ACTIVE PROJECTS Water -glen P.U.D. P & Z Approval: 10/24/94 0 Project has had significant design issues to resolve for utilities, streets, and drainage. Ongoing meetings and discussions with the engineer and applicant have been held since final approval. Current review was just completed and comments have gone back to the engineer on 4/14/97. The applicant has numerous off -site easements to obtain for the off -site street improvements to Vine Drive. As of early 1997 this project has a new developer/owner who is using a different Engineering firm to do the design work. It is unclear at this time how this will effect the review and completion of this project. Cottonwood Ridge Subdivision P & Z Approval: 3/4/96 (rescheduled February meeting) Mylars are ready for final City approval and the development agreement is being drafted. The applicant/owner is working on obtaining the approval of the ditch company and 3 ditch laterals which cross the property as required prior to final City approval of the plans. An issue related to a ROW that was vacated in the Ridge subdivision, adjacent to this project on the west side, has also delayed finalizing the plan approvals. The City is working with the developer to get dedication of easement or right-of-way from The Ridge home owners to correct the problem. 0 Fossil Creek Office Park East P.U.D. P & Z Approval: 3/25/96 This project was inactive after final approval until a resubmittal of the plans was received on 1/30/97. Comments were sent out 2/27/97. Project still has drainage issues to resolve. Stetson Creek 2nd Filing P.U.D. P & Z Approval: 3/25/96 Mylars are approved and the development agreement is being drafted. BMC West P.U.D. P & Z Approval: 5/20/96 Mylars and the development agreement are pending final approval. However, there is a disagreement between the City surveyors and the developer regarding a Section line location. The plat will not be recorded until this is resolved. In addition, there are utility plan revisions needed due to some drainage considerations discovered with the Timberline Road extension project. Recent meetings have been held and this project appears to be moving forward. Huntington Hills P.U.D. 6th Filing P & Z Approval: 5/20/96 Last set of comments were returned on 1/30/97. The next resubmittal will be mylars for final approval. The development agreement is being drafted. Symbios Logic P.U.D. Phase 1 P & Z Approval: 8/26/96 Comments returned to the developer's engineer 4/9/97. Plans are nearing final approval and the development agreement is ready to be drafted. Harmony Safeway Marketplace P.U.D. 0 P & Z APProval: 1017/96(continued September mt . ) Mylars are circulating for final approvals and the development agreement is being negotiated. Harmony Access Plan amended and final approvals estimated to be acquired with in two weeks. Fire Station #12 P.U.D. P & Z Approval: 11/25/96 Plans were resubmitted 4/15/97 with comments due out 5/14/97. Plans are nearing completion and the development agreement is ready to be drafted. Oakridge Business Park 21st Filinq - Hampton Inn P.U.D. Lot 2 P & Z Approval: 12/16/96 Comments were returned to the project engineer on 1/17/97. Awaiting resubmittal from the Developer's engineer. Oakridge Business Park 24th Filing - Oakridge Executive Village P & Z Approval: 1/27/97 There are a few water/wastewater issues to address and then mylars are expected to be submitted for routing. Development agreement is being drafted. Gateway at Harmony P.U.D., Lot 3 - Maken II P & Z Approval: 1/27/97 Plans were resubmitted on 1 /8/97 and comments were returned on 214/97. Awaiting a resubmittal from the Developer's engineer. Hearthfire P.U.D.. 1st Filinq P & Z Approval: 1/27/97 Comments were returned to the Developer's engineer on 2/10/97. There are design details being worked out on the plans. The Developer has to obtain executed off -site easements for the off -site improvements to Douglas Road. 0 0 0 • Ponderosa Park PUD, 2nd Replat P & Z Approval: 2/24/97 Plans will go out to the engineer 5/16/97 and are expected back in for another review. Harmony Towne Center PUD, Circuit City Store P & Z Approval: 3/10/97 (continued February meeting) Revisions sent to Parsons on 4/30/97. We are requesting mylars for the next round and are getting ready to start the Development Agreement. Scenic Views PUD P & Z Approval: 3/10/97 (continued February meeting) This project has been appealed and therefor review will not continue until the appeal has been heard. • Sterling House PUD P & Z Approval: 3/24/97 Plans are in for review and due out 5/27/97. Doerr PUD and Subdivision P & Z Approval: 3/24/97 Harmony School Shops 1st Filing PUD P & Z Approval 3/24197 Plans are currently in for review with comments expected to go out on 5/16/97. Shenandoah PUD, First Filinq P & Z Approval 3/24/97 Comments were returned to the developer's engineer and we are awaiting a resubmittal. Registry Ridge PUD, Phase I �J P & Z Approval 3/24/97 Comments were returned to the developer's engineer and we are awaiting a resubmittal. Park South PUD, Third Replat P & Z Approval 3/24/97 Plans have been in for review and are expected to be returned to the developer's engineeer this week. The next submittal is expected to be mylars and the development agreement will be drafted soon. PROJECTS COMPLETED SINCE THE APRIL 28 PLANNING AND ZONING BOARD MEETING (followed by the time for the project to be completed from final P & Z approval to recording of plat and description of any extenuating circumstances) • Bank One PUD (2 years 7 months - The project was inactive for a period time i and experienced some delays obtaining off site easements) • Greens at Collindale PUD (6 months) • Swallow Townhomes PUD (2 months) ► Dellenbauch Auto Storage PUD (1 months - this project was completed prior to requiring an extension) 0
