Liley LAL/glr Enclosure • WAIVER This Waiver is made this of September, 1997, by Front Range Limited Partnership ("Front Range"): WHEREAS, Front Range is the owner of real property located in the City of Fort Collins, Colorado (the "City") known as the Hugh M. Woods Final P.U.D. (the "P.U.D."); and WHEREAS, the P.U.D. was approved by the Planning and Zoning Board of the City (the "Board") on February 27, 1995 and upheld on appeal by the City Council of the City on April 18, 1995, subject to a condition requiring execution of a Development Agreement between Front Range and the City within two months of the approval (the "Condition"); and WHEREAS, Front Range applied to the Board for an extension, and on May 19, 1997 was granted an extension of time to April 18, 1998 within which to comply with the Condition (the "Extension"), subject to conditions. In satisfaction of the conditions of the Extension imposed by the Board, Front Range hereby: (i) waives any right it may have to assert, in connection with the P.U.D., that the three-year vested right under C.R.S. 24-68-101 execution of the Development final approval of the P.U.D.; further extension pursuant t Development Guidance System o any such request based on a consents to the recording of Clerk and Recorder of Larimer � n o et seq. commences on the date of Agreement rather than the date of (ii) waives any right it may have to either §29-526(H)(3) of the Land r C.R.S. §24-68-101 et seq., except common law vested right; and (iii) this Waiver in the records of the County, Colorado.
