SUBJECT: Clarifications Of Conditions Of Final Approval - Hugh M. Woods
At the May 19, 1997 Planning and Zoning Board meeting, the Board approved a
modification of conditions of final approval for the High M. Woods Final PUD extending
the conditional approval until March 10, 1998. The modification included two
requirements:
A waiver be recorded by the owner waiving any right to assert that the
three year statutory vested right commences on the date of execution of
the development agreement rather than the date of approval of the final
PUD; and,
2. That any right the applicant may have to an extension of such statutory
vested right pursuant to either Colorado statute or City code be waived.
Since this action was taken, it has come to our attention that the March 10, 1998 date
should actually be April 18, 1998. As you may recall, the Board's decision was
appealed to the City Council. The April 18, 1998 date reflects the date that Council
upheld the Board's decision.
am recommending that this change be completed at the June 19, 1997 meeting under
Other Business.
