RE, Hugh M_ woods/Clarification of conditions of Final Approval
Dear Stover:
Dur office represontlo the owner of the site approved as the
Hugh M. Woods Final PUD. On May 19, 1997, the Planning & Zoning
Board aBprove.d a modification of conditions of final approval for
the Hugh X. Woods final PUD, extending the conditional approval
until March lo, 1998 with two requirements: (1) a waiver be:
recorded by the owner waiving any right to assert that the three-
year statutory vested right comm®noes on the Hate of execution of
the Development Agreement. rather than the dates of approval of the
final BUD; and (2) a waiver of any right it may have to an
extension of such statutory vested right pursuant to either
Colorado Statute or city Code.
On June 2, 1997, our office submitted a letter to the planning
& Zoning Board asking for modification of its May 19, 1997
extension approval. SinCA the date of that latter, I have had
several discussions with city start.
The owner is now in agreement with the above two requirements,
provided it is clearly understood that, in granting ouch waivers to
the City, the owner dees not intend to, and does not, waive any
right to assert any common law vested right it may have in
connection With development of the Hugh m. Woods Final PUD.
Finally, I ask the Board to correct the extension date from
March 10, 1998 to April 18, 1998 since the final PUD was approved
by the Board on March 10tb but then appealed to City Council, with
the final decision to uphold the Board's approval given on April
1s, 2995,

With this clarification and correotion, the owner is in
agreement with tha action taken by the Board on may 19, 1997.
