As you know, our firm represents Chandler -Farrell Ventures,
Inc., ("Owner") and Double H Holdings L.L.C., ("Lessee") the owner
and lessee respectively of the property located at 6013 South
College Avenue in Larimer County (the "Property"), which is the
site of the Hickory House South Restaurant.
This letter will serve as confirmation that the Owner and the
Lessee have entered into a binding agreement with Payless Cashways,
Inc. d/b/a Hugh M. Woods ("Developer"), the developer of the Hugh
M. Woods Final P.U.D., wherein the Owner and the Lessee, in
exchange for certain commitments from the Developer, have agreed to
execute and deliver to the City of Fort Collins ("City") a public
access easement ("Easement") to accomplish the realignment of a
portion of the South College frontage road adjacent to the Property
and generally north of Skyway Drive.
Our agreement provides that the Easement will be delivered to
the City after the Hugh M. Woods Final P.U.D. is approved by the
Planning and Zoning Board and concurrently with the approval of the
development agreement and the final utility plans for the
project. The Easement would be delivered to the City with the
agreement of the City that it not be recorded unless and until all
final approvals of the City for the project have been given. If
those are not given by December 31, 1995, the Easement would be
returned to the Owner.
