RECOMMENDATION: Staff recommends adoption of the Resolution and the Ordinances on Second Reading. EXECUTIVE SUMMARY: A. Hearing to Make Determinations and Findings Concerning the Timan First. Annexation. B. Resolution 88-90 Setting Forth Findings of Fact and Determinations Regarding the Timan First Annexation. C. Second Reading of Ordinance No. 67, 1988, Annexing Approximately 56.51 Acres Known as Timan First Annexation. D. Second Reading of Ordinance No. 68, 1988, Zoning Approximately 56.51 Acres Known as Timan First Annexation, into the B-P Planned Business District. This Resolution sets forth findings and determinations that the area is eligible for annexation pursuant to Colorado state law. Ordinance No. 67, 1988 and Ordinance No. 68, 1988, which were unanimously adopted on May 3 on First Reading, annex and zone approximately 56.51 acres located west of College Avenue between Skyway Drive and Trilby Road. The requested zoning is B-P Planned Business District. Staff recommends that a planned unit development condition be attached to the Zoning Ordinance. The property is presently undeveloped. OWNER: Front Range Partnership 2900 South College Ave. 2200 East River Road Fort Collins, CO 80525 Tucson, Arizona 85718 Planning and Zoning Board Recommendation: The Planning and Zoning Board at its May 23 meeting voted 7-0 for approval of the annexation and requested zoning. • u • • • RESOLUTION 88-90 OF THE COUNCIL OF THE CITY OF FORT COLLINS SETTING FORTH FINDINGS OF FACT AND DETERMINATIONS REGARDING THE TIMAN ANNEXATION WHEREAS, annexation proceedings were heretofore initiated for property to be known as the Timan Annexation; and WHEREAS, following Notice given as required by law, the City Council has held a hearing on said Annexation. NOW, THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE CITY OF FORT CO1 1 INS: Section 1. That the City Council hereby finds that the petition for annexation complies with the Municipal Annexation Act. Section 2. That the City Council hereby finds that there is at least one -sixth (1/6) contiguity between the City and the property seeking annexation; that a community of interest exists between the property proposed to be annexed and the City; that said property is urban or will be urbanized in the near future; and that said property is integrated with or is capable of being integrated with the City. Section 3. That the City Council further determines that applicable . parts of said Act have been met, that an election is not required under said Act, and that there are no other terms and conditions to be imposed upon said annexation. Section 5. That the City Council further finds that notice was duly given and a hearing was held regarding the annexation in accordance with said Act. Section 6. That the City Council concludes that the area proposed to be annexed in the Timan Annexation is eligible for annexation to the City of Fort Collins and should be so annexed. Resolution 88-60 Finding Substantial Compliance and Initiating Annexation Proceedings for Timan First Annexation. B. First Reading of Ordinance No. 67 , 1988, Annexing Approximately 56.51 Acres Known as Timan First Annexation. C. First Reading of Ordinance No. 68, 1988, Zoning Approximately 56.51 Acres Known as Timan First Annexation, into the B-P Planned Business District. This is a request to annex and zone approximately 56.51 acres located west of College Avenue between Skyway Drive and Trilby Road. The requested zoning is B-P Planned Business District. Staff recommends that a planned unit development condition be attached to the Zoning Ordinance. The property is presently undeveloped. APPLICANT: RBD, Inc. OWNER: Front Range Partnership 2900 South College Ave. 2200 East River Road Fort Collins, CO 80525 Tucson, Arizona 85718 BACKGROUND: The applicant, RBD, Inc., on behalf of the owner, Front Range Partnership, has submitted a written petition requesting annexation of approximately 56.51 acres located west of College Avenue between Skyway Drive and Trilby Road. the property is located within the Fort Collins Urban Growth Area. According to policies and agreements between the City of Fort Collins and Larimer County contained in the INTERGOVERNMENTAL AGREEMENT FOR THE FORT COLLINS URBAN GROWTH AREA, the City will annex property in the UGA when the DATE: May 3, 1988 . I -2_ ITEM NUMBER: 11 a-c property is eligible for annexation according to State law. The property gains the required 1/6 contiguity to existing city limits from a common boundary with the Trilby Heights Third Annexation to the south. The B-P Planned Business District designation is for areas planned as a unit to provide business services while still protecting surrounding residential areas. The Master Plan for the property indicates a mixed commercial development containing retail and service uses along College Avenue, with office development proposed as a transitional land use between the commercial elements of the plan and the existing residential neighborhood to the west. According to the City's LAND USE POLICIES PLAN, regional/ community shopping centers should locate in areas which are easily accessible to existing or planned residential areas; near transportation facilities that offer the required access without exceeding the capacity of the existing and future transportation network of the City; where they can be served by public transportation; and in areas served by existing water and sewer facilities. The policies also state that transitional land uses or greenbelts should be provided between residential neighborhoods and commercial areas to enhance the concept of mixed land uses. This site addresses these locational policies. Findings: 1. The annexation of this area is consistent with the policies and agreements between Larimer County and the City of Fort Collins contained in the INTERGOVERNMENTAL AGREEMENT FOR THE FORT COLLINS URBAN GROWTH AREA. 2. The area meets all criteria included in State law to qualify for annexation to the City of Fort Collins. 3. The requested B-P Planned Business District is in conformance with the policies of the City's Comprehensive Plan. 4. A planned unit development condition is appropriate for this zoning to ensure design compatibility with surrounding land uses. PLANNING AND ZONING BOARD RECOMMENDATION: The Planning and Zoning Board will hear the request for annexation and zoning at its regular monthly meeting on May 23, 1988.
