Milne, Jr. Box 54 Lucerne, CO This Resolution sets forth findings and determinations that the area is eligible for annexation pursuant to Colorado state law. Ordinance No. 51, 1988 and Ordinance No. 52, 1988, which were unanimously adopted on April 19 on First Reading, anrii,x and zone approximately 144.498 acres located south of East Prospect Road and east of the Poudre River. The requested zoning is the I-G General Industrial District. The property is presently developed and utilized for sand and gravel processing operations. Planning and Zoning Board Recommendation: The Planning and Zoning Board at its April 25 meeting voted 7-0 for approval of the annexation and requested zoning. RESOLUTION 88-86 OF THE COUNCIL OF THE CITY OF FORT COLLINS SETTING FORTH FINDINGS OF FACT AND DETERMINATIONS REGARDING THE FLATIRON EAST PROSPECT ROAD FIRST ANNEXATION WHEREAS, annexation proceedings were heretofore initiated for property to be known as the Flatiron East Prospect Road First Annexation; and WHEREAS, following Notice given as required by law, the City Council has held a hearing on said Annexation. NOW, THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE CITY OF FORT COLLINS: Section 1. That the City Council hereby finds that the petition for annexation complies with the Municipal Annexation Act. Section 2. That the City Council hereby finds that there is at least one -sixth (1/6) contiguity between the City and the property seeking annexation; that a community of interest exists between the property proposed to be annexed and the City; that said property is urban or will be urbanized in the near future; and that said property is integrated with or is capable of being integrated with the City. Section 3. That the City Council further determines that applicable parts of said Act have been met, that an election is not required under said Act, and that there are no other terms and conditions to be imposed upon said annexation. Section 5. That the City Council further finds that notice was duly given and a hearing was held regarding the annexation in accordance with said Act. Section 6. That the City Council concludes that the area proposed to be annexed in the Flatiron East Prospect Road First Annexation is eligible for annexation to the City of Fort Collins and should be so annexed. DATE: April 19, 1988 M 1 -2- • ITEM NUMBER: 7 a-c BACKGROUND: The applicant, Cottonwood Farms a Colorado general partnership, on behalf of the owners the Flatiron Companies, the Prospect Land Company and Mr. James G. Milne Jr. of Lucerne, Colorado, has submitted a written petition requesting annexation of approximately 144.498 acres located south of Fast Prospect Road and east of the Poudre River. The requested zoning is the I-G General Industrial District. The property is presently developed and utilized for sand and gravel processing operations. This is a voluntary annexation. The property is located within the Fort Collins Urban Growth Area. According to policies and agreements between the City of Fort Collins and Larimer County contained in the INTERGOVERNMENTAL AGREEMENT FOR THE FORT COLLINS URBAN GROWTH AREA, the City will annex property in the UGA when the property is eligible for annexation according to State law. The property gains the required 1/6 contiguity to existing city limits from a common boundary with the Northern Colorado Nature Center First and Second Annexations to the south and east. The City of Fort Collins has desired to annex its Resource Recovery Farm for several years. In order to gain the necessary contiguity to allow the annexation of the Resource Recovery Farm, several other properties had to annex into the city. The first properties to annex were owned by the Colorado Board of Agriculture and were annexed under the names Colorado Nature Center First and Second Annexations in 1987. The Flatiron East Prospect Road First Annexation gains its contiguity from the state-owned property and will provide the necessary contiguity required for the City to annex its property. The requested zoning for this annexation is the I-G General Industrial District. The I-G District designation allows any business, commercial, industrial or manufacturing use. The property is presently developed and utilized for sand and gravel processing, a use the owner wishes to maintain and expand in the future. According to the City's LAND USE POLICIES PLAN, industrial uses should locate near transportation facilities that offer the required access to the industry but do not exceed the capacity of the existing and future transportation network of the City. This site addresses these locational policies. As indicated above, the property is presently developed and utilized for sand and gravel processing, a use the owner wishes to continue and expand at some point in the future. In an analysis of the requested I-G zone, staff saw no problems with the continuation or expansion of the existing use. Staff, however, identified several potential problems with future uses of the property if zoned I-G, a zone which allows any commercial, business or industrial use. To address the potential problems, staff successfully negotiated two zoning conditions with the applicant and owners of the property as part of an Annexation Agreement which will be signed by the City and the owners (see Attachment B): (1) the first condition defines the "existing use" of the property and indicates that such a use can expand without a requirement of a planned unit development (PUD); and (2) the second condition indicates that any proposed redevelopment of the property from the "existing use" shall be required to be a PUD. Staff believes these conditions satisfy the owners and protect the community in regards to controlling future development. DATE: April 19, 1988 0 -3- NUMBER: 7 a-c Findings 1. The annexation of this area is consistent with the policies and agreements between Larimer County and the City of Fort Collins contained in the INTER GOVERNMENTAL AGREEMENT FOR THE FORT COLLINS URBAN GROWTH AREA. 2. The area meets all criteria included in State law to qualify for a voluntary annexation to the City of Fort Collins. 3. The attached Resolution accepts the annexation petition and determines that the petition is in compliance with State law. The Resolution also initiates the annexation process for this property by establishing the date, time and place when a public hearing will be held regarding the readings of the Ordinances annexing and zoning the area. Public hearing and second reading of the Ordinances annexing and zoning the property will be considered by the City Council on June 7, 1988. 4. The requested I-G General Industrial District is in conformance with the policies of the City's Comprehensive Plan. STAFF RECOMMENDATION: Staff recommends approval of the annexation and requested zoning with the signing of the Annexation Agreement defining allowable uses of the property. PLANNING AND ZONING BOARD RECOMMENDATION: The Planning and Zoning Board will review this annexation request at its April 25, 1988, meeting and will forward a recommendation to the Council in time for the public hearing and second ordinance readings on June 7, 1988. FLATIRON EAST PROSPECT ROAD FIRST - ANNEXATION AND ZONING Ken Waido gave the description of the project. He stated staff had placed two conditions on the plan. These were, (1) the property be used for sand and gravel processing; and (2) if the property were redeveloped the applicant would resubmit to the Board the project as a PUD. He noted staff recommends approval. Lloyd Banks stated he was trying to figure out where he is located in relation to the project. Ken Waido informed Mr. Banks that his property was not part of the area to be annexed. • Member Crews moved to approve Flatiron East Prospect Road First -Annexation and Zoning. Member Kern seconded. Motion passed 7-0. PARK CENTRAL PUD, PHASE III - PRELIMINARY Debbie deBesche gave the description of the project. Frank Vaught stated this project has been in the planning process for ten years. He commented that originally the project was under single ownership. Today there were three separate parcels. lie added the most recent change occurred in 1985. It transformed the center section into office/retail space. lie stated that a traffic analysis and car counts had been conducted during the hours of 11:30 a.m. to 1:30 p.m. and 4:30 p.m. to 6:30 p.m. Overall, he stated, the goal was to create a professional office atmosphere. He believed that the plan achieves the goal. He commented that the cluster of buildings and parking was more sensitive to the neighborhood and pedestrians. He discussed the four conditions staff placed on the project. The conditions included (1) That prior to final approval of the plan, the applicant provide additional information to justify the distribution of parking on the site, particularly the parking between the health club and office Building F; (2) That prior to final approval, the applicant provide additional information to justify the shared parking assumptions, in particular, the peaking characteristics of the office uses; (3) That prior to final approval, the ITEM FLATIRON EAST PROSPECT ROAD FIRST Annexation &Zoning NUMBER 28-88, a 0
