Box 229 Boulder, CO 80522 Dear Mike, This .letter will help confirm what we discussed on the telephone last Fri- day concerning the annexation of property owned by Flatiron Sand and Gravel Company located along East Prospect Road. I am really pleased to see that things are moving along quite well. As you know, I received your letter of October 2, 1987, along with an Annexation Petition and map of the area to be annexed. The Assistant City Attorney and I have had an opportunity to review the submitted items (his suggested changes are in blue, mine are in red) and we would like to make the following suggestions. 1. The City of Fort Collins would like to see the three additional parcels, Parcels E (33.160 acres), F (4.205 acres), and G (3.395 acres), included in the Annexation Petition. 2. The Annexation Petition will need to be revised to include the following items: a. The name of the annexation will be the FLATIRON EAST PROSPECT ROAD FIRST ANNEXATION. y b. The total area of the annexation will be 144.508 acres, consisting of: Parcel C 27.487 acres Parcel D 70.837 acres Parcel E 33.160 acres Parcel F 4.205 acres Parcel G 3.395 acres Parcel H 2.000 Acres Prospect R-O-W 3.424 acres Total 144.508 acres OFFICE OF DEVELOPMENT T 300 LaPorte Ave. • P.O. ATTACHMENT A, the legal description of the entire annexation, will need to include the entire right-of-way for East Prospect Road. State law requires a municipality, when annexing a portion of a street right-of-way, to include the entire street right-of-way in the annexation. d. Each of the parcels to be included in the annexation (C, D, E, F, G, and H) will need to have its specific legal description placed on the sheet titled LEGAL DESCRIPTION OF REAL PROPERTY INCLUDF,D IN THE ANNEXATION signed by the appropriate owner(s) of each parcel. e. The "WHEREFORE" paragraph on page 2 should eliminate all wording beginning with "use limited to sand and gravel processing....." to the end of the paragraph and substitute "two conditions as specified in the Annexation Agreement between Cottonwood Farms, a Colorado general partnership, and the City of Fort Collins which is attached hereto as Attachment "B" and incorporated herein." 3. ATTACHMENT B to the Annexation Petition containing the specifics of the ANNEXATION AGREEMENT will need to be revised to include the following items: a. Paragraph 2 on page 5 should be reworded after "an I-G, General Industrial, Zoning District with" as follows: "the following two conditions, (1) limiting the use of the Property to the Existing Use, as defined below, and (2) any proposed redevelopment of the Property from the Existing Use shall be submitted and reviewed for approval as a Planned Unit Development." b. Paragraph 3 on page 5 should place a period (.) after "Planned Unit Development" and eliminate the rest of the wording beyond that point. c. Paragraph 6 on page 7 should be eliminated and the following para- graphs re -numbered accordingly. The City of Fort Collins is having an Annexation Plat for the Flatiron East Prospect Road First Annexation drawn based on information which has been submitted. I will forward a copy of that plat for your review when it has been completed. We also discussed the possibility of annexing property located north of East Prospect Road and placing such property into the T-Transition Zoning District. We can follow a similar procedure, whereby, if you could provide me with a legal description and Annexation Petition for the property I will have the required annexation plat prepared.
