Dear Ms. Shoemaker,
Enclosed are the following items, requested by telephone, to help with
the annexation of land into the City of Fort Collins owned Flatiron Sand &
Gravel Company located along East Prospect Road:
1. Annexation Petition.
2. City of Fort Collins Zoning Code.
In previous discussions with Mr. Mike Hart, I indicated the Planning
Department would support an I-G, General Industrial, Zoning District
request with a zoning condition limiting the property's use to that of
"sand and gravel extraction and processing operations." The zoning condi-
tion would allow Flatiron to conduct and expand their current operation but
would require a rezoning and City review of any proposed change of use. In
an annexation "agreement" or the zoning "condition" it should be defined as
clearly as possible what constitutes "sand and gravel extraction and pro-
cessing operations" so future problems of interpretation can be avoided.
If you could please see that the enclosed Annexation Petition is prop-
erly completed with any attachments desired by Flatiron. The City of Fort
Collins will prepare the required Annexation Plat. The actual legal
description of the total area to be annexed will differ from the legal
description of the property owned by Flatiron involved in the annexation.
State law requires the annexation of all adjacent road right-of-ways and
1/6 contiguity to existing City limits.
