RECOMMENDATION:
Staff recommends adoption of the Resolution and the Ordinances on Second
Reading.
EXECUTIVE SUMMARY:
A. Resolution 88-87 Setting Forth Findings of Fact and Determinations
Regarding the Sludge Farm Annexation.
B. Second Reading of Ordinance No. 53, 1988, Annexing Approximately
324.1479 Acres, Known as the Sludge Farm Annexation.
C. Hearing Regarding Zoning of the Sludge Farm Annexation.
D. Second Reading of Ordinance No. 54, 1988, Zoning Approximately 324.1479
Acres, Known as the Sludge Farm Annexation, into the RC River Corridor
District.
APPLICANT: City of Fort Collins OWNER: Same
This Resolution sets forth findings and determinations that the area is
eliyible for annexation pursuant to Colorado state law. Ordinance No. 53,
1988 and Ordinance No. 54, 1988, which were unanimously adopted on April 19
on First Reading, annex and zone approximately 324.1479 acres located south
of East Prospect. Road and west of I-25. The requested zoning is the RC
River Corridor District. The property is presently developed as the City's
Resource Recovery Farm. This is a voluntary annexation.
Planning and Zoning Board Recommendation:
The Planning and Zoning Board at its April 25 meeting voted 7-0 for
approval of the annexation and requested zoning, as part of the Board's
Consent Agenda.

OF THE COUNCIL OF THE CITY OF FORT COLLINS
SETTING FORTH FINDINGS OF FACT AND DETERMINATIONS
REGARDING III[- SI UDGE [ ARM ANNEXAI ION
BE IT RESOLVED BY THE COUNCIL OF THE CITY OF FORT COLLINS:
Section 1. That the City Council hereby finds that the area proposed
to be annexed as the Sludge Farm Annexation is solely owned by the City of
Fort Collins and is not solely a public street or right-of-way.
Section 2. That the City Council concludes that the area proposed to
be annexed is eligible for annexation to the City of Fort Collins in
accordance with the provisions of Sections 31-12-104(1)(a) and 31-12-105,
C.R.S., and should be so annexed.
Section 3. That the City Council hereby finds that said area may be
annexed by ordinance without notice and hearing.
Passed and adopted at a regular meeting of the Council of the City of
Fort Collins held this 7th day of June, A.D. 1988.

B. First Reading of Ordinance No. , 1988, Zoning Approximately
324.1479 Acres, Known as the Sludge Farm Annexation, into the RC River
Corridor District.
APPLICANT: City of Fort Collins OWNER: Same
This is a request to annex and zone approximately 324.1479 acres located
south of East Prospect Road and west of I-25. The requested zoning is the
RC River Corridor District. The property is presently developed as the
City's Resource Recovery Farm. This is a voluntary annexation.
BACKGROUND:
The applicant and owner, the City of Fort Collins, has submitted a written
petition requesting annexation of approximately 324.1479 acres located
south of East Prospect Road and west of I-25. The requested zoning is the
RC River Corridor District. The property is presently developed as the
City's Resource Recovery Farm. This is a voluntary annexation.
The property is located within the Fort Collins Urban Growth Area.
According to policies and agreements between the City of Fort Collins and
Larimer County contained in the INTERGOVERNMENTAL AGREEMENT FOR THE FORT
COLLINS URBAN GROWTH AREA, the City will annex property in the UGA when the
property is eligible for annexation according to State law. The property
gains the required 1/6 contiguity to existing city limits from a common
boundary with the Flatiron East Prospect Road First Annexation to the west.

The requested zoning for this annexation is the RC River Corridor District.
The RC District designation is for areas developing within the corridor of
the Cache La Poudre River. The RC district places strong emphasis on
area/neighborhood planning to define appropriate uses in the river
corridor. Staff is presently working with property owners in the East
Prospect Road area to develop an entry -way land use and urban design plan.
When completed this plan will establish development and design guidelines
for the area.
Findings
1. The annexation of this area is consistent with the policies and
agreements between Larimer County and the City of Fort Collins
contained in the INTERGOVERNMENTAL AGREEMENT FOR THE FORT COLLINS URBAN
GROWTH AREA.
2. The area meets all criteria included in State law to qualify for a
voluntary annexation to the City of Fort Collins.

property will be considered by the City Council on June 7, 1988.
4. The requested RC River Corridor District is in conformance with the
policies of the City's Comprehensive Plan.
PLANNING AND ZONING RECOMMENDATION:
The Planning and Zoning Board will review the Sludge Farm Annexation at
their April 25, 1988, meeting and will forward a recommendation to the
Council in time for the public hearings and second ordinance readings
scheduled for the Council meeting of June 7, 1988.

ANNEXING PROPERTY KNOWN AS THE
SLUDGE FARM ANNEXATION
TO THE CITY OF FORT COLLINS, COLORADO
WHEREAS, the area to be annexed is solely owned by the City and is not
solely a public street or right-of-way; and
WHEREAS, the Council of the City of Fort Collins has found and
determined and does hereby find and determine that it is in the best
interests of the City of Fort Collins to annex said area to the City.
NOW, THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE CITY OF FORT

property hereby annexed except as may be provided by the ordinances of the
City of Fort Collins.
