RECOMMENDATION:
Staff recommends adoption of the Resolution and the Ordinances on Second
Reading.
EXECUTIVE SUMMARY:
A. Resolution 88-88 Setting Forth Findings of Fact and Determinations
Regarding the Strauss Cabin First Annexation.
B. Second Reading of Ordinance No. 55, 1988, Annexing Approximately
27.6055 Acres, Known as the Strauss Cabin First Annexation.
C. Hearing Regarding Zoning of the Strauss Cabin First Annexation.
D. Second Reading of Ordinance No. 56, 1988, Zoning Approximately 27.6055
Acres, Known as the Strauss Cabin First Annexation, into the RC River
Corridor District.
APPLICANT: City of Fort Collins OWNERS: Same
This Resolution sets forth findings and determinations that the area is
eligible for annexation pursrjL-rnt to Colorado state law. Ordinance No. 55,
1988 and Ordinance No. 56, 1988, which were unanimously adopted on April 19
on First Reading, annex and zone approximately 27.6055 acres located south
of East Prospect Road and west of I-25. The requested zoning is the RC
River Corridor District. The property is presently developed as part of
the City's Resource Recovery Farm. This is a voluntary annexation.
Planning and Zoning Board Recommendation:
The Planning and Zoning Board at its April 25 meeting voted 7-0 for
approval of the annexation and requested zoning, as part of the Board's
Consent Agenda.

• RESOLUTION 88-88
OF THE COUNCIL OF THE CITY OF FORT COLLINS
SETTING FORTH FINDINGS OF FACT AND DETERMINATIONS
REGARDING THE STRAUSS CABIN SECOND ANNEXATION
BE IT RESOLVED BY THE COUNCIL OF THE CITY OF FORT COLLINS:
Section 1. That the City Council hereby finds that the area proposed
to be annexed as the Strauss Cabin Second Annexation is solely owned by the
City of Fort Collins and is not solely a public street or right-of-way.
Section 2. That the City Council concludes that the area proposed to
be annexed is eligible for annexation to the City of Fort Collins in
accordance with the provisions of Sei_tions 31 12-104(1)(a) and 31-12 105,
C.R.S., and should be so annexed.
Section 3. That the City Council hereby finds that said area may be
annexed by ordinance without notice and hearing.
Passed and adopted at a regular meeting of the Council of the City of
Fort Collins held this 7th day of June, A.D. 1988.

EXECUTIVE SUMMARY:
A. First Reading of Ordinance No. 57, 1988, Annexing Approximately 46.4996
Acres, Known as the Strauss Cabin Second Annexation.
B. First Reading of Ordinance No. 58, 1988, Zoning Approximately 46.4996
Acres, Known as the Strauss Cabin Second Annexation, into the RC River
Corridor District.
APPLICANT: City of Fort Collins OWNERS: Same
This is a request to annex and zone approximately 46.4996 acres located
south of East Prospect Road and west of 1-25. The requested zoning is the
RC River Corridor District. The property is presently developed as part of
the City's Resource Recovery Farm. This is a voluntary annexation.
BACKGROUND:
The applicant and owner, the City of Fort Collins, has submitted a written
petition requesting annexation of approximately 46.4996 acres located south
of East Prospect Road and west of I-25. The requested zoning is the RC
River Corridor District. The property is presently developed as part of
the City's Resource Recovery Farm. This is a voluntary annexation of
municipally -owned land, and is therefore exempt, under state law, from the
requirement of notice and public hearing, for the annexation.
The property is located within the Fort Collins Urban Growth Area.
According to policies and agreements between the City of Fort Collins and
Larimer County contained in the INTERGOVERNMENTAL AGREEMENT FOR THE FORT
COLLINS URBAN GROWTH AREA, the City will annex property in the UGA when the
property is eligible for annexation according to State law. The property
gains the required 1/6 contiguity to existing city limits from a common
boundary with the Strauss Cabin Second Annexation to the northwest.

The requested zoning for this annexation is the RC River Corridor District.
The RC District designation is for areas developing within the corridor of
the Cache La Poudre River. The RC District places strong emphasis on the
development of area/neighborhood plans. Staff is presently working with
the property owners along East prospect Road to develop an entry -way land
use and urban design plan for the area. This plan will identify
appropriate uses and urban design considerations as guidelines for the area
as it develops.
Findings
1. The annexation of this area is consistent with the policies and
agreements between Larimer County and the City of Fort Collins
contained in the INTERGOVERNMENTAL AGREEMENT FOR THE FORT COLLINS URBAN
GROWTH AREA.
2. The area meets all criteria included in State law to qualify for a
voluntary annexation of municipally -owned land to the City of Fort
Collins.
3. Public hearing on zoning of the land, and second reading of the
Ordinances annexing and zoning the property will be considered by the
City Council on June 7, 1988.
4. The requested RC River Corridor District is in conformance with the
policies of the City's Comprehensive Plan.
PLANNING AND ZONING BOARD RECOMMENDATION:
The Planning and Zoning Board will review this annexation and zoning
request at its April 25, 1988, meeting and will forward a recommendation to
the Council in time for the public hearing and second readings of the
Ordinances annexing and zoning this property scheduled for June 7, 1988.
