RECOMMENDATION: Staff recommends approval of the annexation and zoning request. EXECUTIVE SUMMARY: A. First Reading of Ordinance No. , 1988, Annexing Approximately 46.4996 Acres, Known as the Strauss Cabin Second Annexation. B. First Reading of Ordinance No. , 1988, Zoning Approximately 46.4996 Acres, Known as the Strauss Cabin Second Annexation, into the RC River Corridor District. APPLICANT: City of Fort Collins OWNERS: Same This is a request to annex and zone approximately 27.6055 acres located south of East Prospect Road and west of I-25. The requested zoning is the RC River Corridor District. The property is presently developed as part of the City's Resource Recovery Farm. This is a voluntary annexation. BACKGROUND: The applicant and owner, the City of Fort Collins, has submitted a written petition requesting annexation of approximately 46.4996 acres located south of East Prospect Road and west of I-25. The requested zoning is the RC River Corridor District. The property is presently developed as part of the City's Resource Recovery Farm. This is a voluntary annexation. The property is located within the Fort Collins Urban Growth Area. According to policies and agreements between the City of Fort Collins and Larimer County contained in the INTERGOVERNMENTAL AGREEMENT FOR THE FORT COLLINS URBAN GROWTH AREA, the City will annex property in the UGA when the property is eligible for annexation according to State law. The property gains the required 1/6 contiguity to existing city limits from a common boundary with the Strauss Cabin Second Annexation to the northwest. -2- The requested zoning for this annexation is the RC River Corridor District. The RC District designation is for areas developing within the corridor of the Cache La Poudre River. The RC district places strong emphasis on the development of area/neighborhood plans. Staff is presently working with the property owners along East prospect Road to develop an entry -way land use and urban design plan for the area. This plan will identify appropriate uses and urban design considerations as guidelines for the area as it develops. Findings 1. The annexation of this area is consistent with the policies and agreements between Larimer County and the City of Fort Collins contained in the INTERGOVERNMENTAL AGREEMENT FOR THE FORT COLLINS URBAN GROWTH AREA. 2. The area meets all criteria included in State law to qualify for a voluntary annexation to the City of Fort Collins. 3. Public hearing and second reading of the Ordinances annexing and zoning the property will be considered by the City Council on June 7, 1988. 4. The requested RC River Corridor District is in conformance with the policies of the City's Comprehensive Plan. PLANNING AND ZONING BOARD RECOMMENDATION: The Planning and Zoning Board will review this annexation and zoning request at their April 25, 1988, meeting and will forward a recommendation to the Council in time for the public hearing and second readings of the Ordinances annexing and zoning this property scheduled for June 7, 1988. ORDINANCE NO. , 1988 OF THE COUNCIL OF THE CITY OF FORT COLLINS AMENDING CHAPTER 29 OF THE CODE OF THE CITY OF FORT COLLINS, COMMONLY KNOWN AS THE ZONING ORDINANCE, AND CLASSIFYING FOR ZONING PURPOSES THE PROPERTY INCLUDED IN THE STRAUSS CABIN SECOND ANNEXATION TO THE CITY OF FORT COLLINS, COLORADO BE IT ORDAINED BY THE COUNCIL OF THE CITY OF FORT COLLINS as follows: Section 1. That the Zoning District Map adopted by Chapter 29 of the Code of the City of Fort Collins be, and the same hereby is, changed and amended by including the property known as the Strauss Cabin Second Annexation to the City of Fort Collins, Colorado, in the "RC" River Corridor District: A tract of land situate in the West Half of Section 27 and the Northeast Quarter of Section 28, Township 7 North, Range 68 West of the 6th P.M., Larimer County, Colorado, which considering the North line of the Northwest Quarter of Section 27 as bearing S 89°5536" E and with all bearings contained herein relative thereto is contained within the boundary lines which begin at the Northwest corner of Section 27 and run thence along the North line of Section 27 S 89°55'36" E 344.16 feet to the true point of beginning; thence along the Westerly ROW line of Highway I-25 the next seven courses, being S 12°20'22" E 321.64 feet; thence S 02°37'15" E 304.35 feet; thence S 12°27'49" E 1000.00 feet; thence N 77°23'38" E 52.02 feet; thence S 12037'26" E 2001.10 feet; thence S 09°02'56" E 801.60 feet; thence S 12°37'26" E 108.55 feet; thence leaving the Westerly ROW line of Highway I-25 N 56°33'11" W 614.56 feet; thence N 17°34'30" E 691.10 feet; thence N 55°32'10" W 437.43 feet; thence N 42°19'41" W 510.01 feet; thence N 19°55'28" W 848.85 feet; thence N 15°25'11" W 274.59 feet; thence N 13°56'28" E 1801.77 feet to the true point of beginning. Section 2. That the City Engineer is hereby authorized and directed to amend said Zonina District Mao in accordance with this Ordinance. Mayor ATTEST: City Clerk Passed and adopted on final reading this 7th day of June, A.D. 1988. ayor ATTEST: City Cler ORDINANCE NO. , 1988 OF THE COUNCIL OF THE CITY OF FORT COLLINS ANNEXING PROPERTY KNOWN AS THE STRAUSS CABIN SECOND ANNEXATION TO THE CITY OF FORT COLLINS, COLORADO WHEREAS, the area to be annexed is solely owned by the City and is not solely a public street or right-of-way; and WHEREAS, the Council of the City of Fort Collins has found and determined and does hereby find and determine that it is in the best interests of the City of Fort Collins to annex said area to the City. NOW, THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE CITY OF FORT COLLINS as follows: Section 1.
