Collins, CO 80523 Re: Rigdon Farm Annexation Dear Mr. Jesser: I am transmitting herewith two copies of the final annexation plat for the Rigdon Farm Annexation. The area included within this annexation is that area shown by the legal description provided, less the area in the southeast quarter which was already included in the Blue Spruce Farm Annexation, plus that portion of the East Drake Road ROW adjacent to the north boundary of your property. My research of county road right-of-way indicates that the County Road #9 ROW on the east side of Section 29 actually falls totally within the adjacent Section 28, and does not abut Section 29. Accordingly, I have not included any additional road ROW on the easterly boundary of your property. It may be of interest for you to know that in my research of dedicated ROW I received a letter from Jack C. Loucks, ROW Agent for Larimer County, in which he indicates that in Book R, Page 64 of the Larimer County records there is a description of a road going diagonally through Section 29. I obtained a copy of that record, and enclose it for your review. Although the dia- gram shows a diagonal road, I cannot find a description of it in the written material. I point this out only so you can take what action you may see fit to determine if such a ROW is in fact dedicated. If there really is such a dedication it may be necessary for you to have that ROW vacated by the County Commissioners to remove it. If you have questions, or need additional information regarding this annexation plat, please advise. College Ave. Fort Collins, CO 80525 RE: ROW RESEARCH FOR CR 9 AND CR 42 Dear Mr. Irelan, At your request I have researched the right-of-way for County Roads 9 and 42 in Section 29-7-68 and the following documents apply: BOOK PAGE R 64 151 532 180 488 180 489 5 19 These documents may be viewed at the County Clerk and Recorder's office and copies may be obtained from there. The document listed as Book R, Page 64 describes a road going diagonally through section 29. Although there is no road presently located there, you might consider having the Board of County Commissioners take action to vacate the road to eliminate any problems it might cause regarding the property. I doubt this would be -reflected in a search by a Title Company, unless it is pointed out to them, since most Title Companies don't know much about old County right-of-way since they are not deeded nor are they recorded in the Grantee -Grantor books.
